55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the reimbursement of wound care education and training
88 services providers under Medicaid.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.02492 to read as follows:
1212 Sec. 32.02492. REIMBURSEMENT OF CERTAIN PROVIDERS OF WOUND
1313 CARE EDUCATION AND TRAINING SERVICES. (a) The commission shall
1414 provide medical assistance reimbursement to an authorized wound
1515 care education and training services provider who provides to a
1616 recipient necessary wound care education and training.
1717 (b) The commission shall approve a person as an authorized
1818 wound care education and training services provider if the person:
1919 (1) is enrolled as a provider under the medical
2020 assistance program; and
2121 (2) meets quality standards for wound care education
2222 and training approved by the commission.
2323 (c) An authorized wound care education and training
2424 services provider shall determine a recipient's need for wound care
2525 education and training services. The provider must certify that
2626 the education and training is necessary for the recipient to
2727 provide self-care in order to assist in wound care management and to
2828 improve the recipient's health care outcomes.
2929 (d) The executive commissioner, after consulting with
3030 organizations that assist individuals with wound care, including
3131 recipients of medical assistance, shall:
3232 (1) adopt reimbursement rates for an authorized wound
3333 care education and training services provider for the provision of
3434 wound care education and training services; and
3535 (2) establish outcome measures for evaluating the
3636 health care outcomes of recipients who receive wound care education
3737 and training services from an authorized wound care education and
3838 training services provider.
3939 SECTION 2. If before implementing any provision of this Act
4040 a state agency determines that a waiver or authorization from a
4141 federal agency is necessary for implementation of that provision,
4242 the agency affected by the provision shall request the waiver or
4343 authorization and may delay implementing that provision until the
4444 waiver or authorization is granted.
4545 SECTION 3. This Act takes effect September 1, 2021.
