5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the reimbursement of wound care education and training
8	8	services providers under Medicaid.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
11	11	is amended by adding Section 32.02492 to read as follows:
12	12	Sec. 32.02492. REIMBURSEMENT OF CERTAIN PROVIDERS OF WOUND
13	13	CARE EDUCATION AND TRAINING SERVICES. (a) The commission shall
14	14	provide medical assistance reimbursement to an authorized wound
15	15	care education and training services provider who provides to a
16	16	recipient necessary wound care education and training.
17	17	(b) The commission shall approve a person as an authorized
18	18	wound care education and training services provider if the person:
19	19	(1) is enrolled as a provider under the medical
20	20	assistance program; and
21	21	(2) meets quality standards for wound care education
22	22	and training approved by the commission.
23	23	(c) An authorized wound care education and training
24	24	services provider shall determine a recipient's need for wound care
25	25	education and training services. The provider must certify that
26	26	the education and training is necessary for the recipient to
27	27	provide self-care in order to assist in wound care management and to
28	28	improve the recipient's health care outcomes.
29	29	(d) The executive commissioner, after consulting with
30	30	organizations that assist individuals with wound care, including
31	31	recipients of medical assistance, shall:
32	32	(1) adopt reimbursement rates for an authorized wound
33	33	care education and training services provider for the provision of
34	34	wound care education and training services; and
35	35	(2) establish outcome measures for evaluating the
36	36	health care outcomes of recipients who receive wound care education
37	37	and training services from an authorized wound care education and
38	38	training services provider.
39	39	SECTION 2. If before implementing any provision of this Act
40	40	a state agency determines that a waiver or authorization from a
41	41	federal agency is necessary for implementation of that provision,
42	42	the agency affected by the provision shall request the waiver or
43	43	authorization and may delay implementing that provision until the
44	44	waiver or authorization is granted.
45	45	SECTION 3. This Act takes effect September 1, 2021.
