66 AN ACT
77 relating to the establishment of the Texas Computational Health
88 Research Institute.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1111 amended by adding Chapter 54 to read as follows:
1212 CHAPTER 54. TEXAS COMPUTATIONAL HEALTH RESEARCH INSTITUTE
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 54.0001. DEFINITIONS. In this chapter:
1515 (1) "Executive committee" means the executive
1616 committee of the institute.
1717 (2) "Institute" means the Texas Computational Health
1818 Research Institute established under this chapter.
1919 SUBCHAPTER B. INSTITUTE
2020 Sec. 54.0051. ESTABLISHMENT; PURPOSE. The Texas
2121 Computational Health Research Institute is established to leverage
2222 the expertise and capacity of certain health-related institutions
2323 by developing computational models to:
2424 (1) assist health care providers with identifying
2525 individual risk factors when treating a specific disease or injury
2626 or performing a specific health care procedure; and
2727 (2) determine the most cost-effective method to
2828 achieve the optimal health outcome in the treatment of a specific
2929 disease or injury or the performance of a specific health care
3030 procedure.
3131 Sec. 54.0052. COMPOSITION. The institute is composed of:
3232 (1) the Texas Advanced Computing Center;
3333 (2) The University of Texas at Austin; and
3434 (3) other health-related institutions and
3535 health-related institutions of higher education the executive
3636 committee considers necessary, subject to the availability of
3737 funds.
3838 Sec. 54.0053. ADMINISTRATIVE ATTACHMENT. The institute is
3939 administratively attached to the Texas Higher Education
4040 Coordinating Board and is funded solely by money appropriated to
4141 the coordinating board for the institute. The coordinating board
4242 may use an amount not to exceed three percent of the money
4343 appropriated for the institute, as approved by the executive
4444 committee, to provide administrative support to the institute.
4545 SUBCHAPTER C. EXECUTIVE COMMITTEE
4646 Sec. 54.0101. COMPOSITION. The institute is governed by an
4747 executive committee composed of the following members:
4848 (1) a representative of the Texas Advanced Computing
4949 Center, designated by the executive director of the center;
5050 (2) a representative of The University of Texas at
5151 Austin with expertise in health care, designated by the president
5252 of the university;
5353 (3) a representative of any other health-related
5454 institution or health-related institution of higher education the
5555 executive committee includes in the composition of the institute,
5656 designated by the executive head of the institution; and
5757 (4) any other member, designated by a majority of the
5858 executive committee.
5959 Sec. 54.0102. VACANCY. A vacancy on the executive
6060 committee shall be filled in the same manner as the original
6161 appointment.
6262 Sec. 54.0103. PRESIDING OFFICER. The executive committee
6363 shall elect a presiding officer from among the membership of the
6464 executive committee.
6565 Sec. 54.0104. GENERAL DUTIES. The executive committee
6666 shall:
6767 (1) establish procedures for requesting a
6868 computational model that complies with Subchapter D;
6969 (2) establish procedures and policies for the
7070 administration of funds under this chapter; and
7171 (3) establish procedures to document compliance by
7272 executive committee members and staff with applicable laws
7373 governing conflicts of interest.
7474 Sec. 54.0105. REPORT TO LEGISLATURE. Not later than
7575 January 1 of each odd-numbered year, the executive committee shall
7676 submit a report to the legislature on the achievements of the
7777 institute, including the computational models developed by the
7878 institute, in the preceding two years.
7979 SUBCHAPTER D. HEALTH CARE COMPUTATIONAL MODELING
8080 Sec. 54.0151. REQUEST FOR COMPUTATIONAL MODEL. (a) A
8181 member of the legislature or a health care provider may request the
8282 institute to develop a computational model for:
8383 (1) treating a specific disease or injury; or
8484 (2) performing a specific health care procedure.
8585 (b) The institute shall determine whether to accept a
8686 request to develop a computational model and provide a response to
8787 the requestor not later than the 30th day after the date the request
8888 is received by the institute.
8989 Sec. 54.0152. COMPUTATIONAL MODEL REQUIREMENTS. If the
9090 institute accepts a request under Section 54.0151, the institute
9191 shall develop a computational model that:
9292 (1) allows a health care provider to assess risk
9393 factors for an individual patient in treating the disease or
9494 injury, or performing the health care procedure, as applicable;
9595 (2) provides a health care provider clinical
9696 recommendations for treatment of the disease or injury, or
9797 performance of the health care procedure, as applicable, based on a
9898 patient's risk factors to achieve the optimal health outcome in the
9999 most cost-effective manner;
100100 (3) is based on data:
101101 (A) supported by relevant health care experts and
102102 literature; and
103103 (B) acquired over a period sufficiently recent to
104104 have significant scientific value for the treatment of the disease
105105 or injury or performance of the health care procedure; and
106106 (4) does not disclose any personally identifiable
107107 information of individuals included in the model's data.
108108 Sec. 54.0153. DATA REQUEST. (a) The institute may request
109109 relevant data to develop a model requested under Section 54.0151
110110 from a state agency, health-related institution, or health-related
111111 institution of higher education.
112112 (b) A person electing to provide data in response to a
113113 request submitted under Subsection (a) shall ensure the data does
114114 not contain any personally identifiable information.
115115 SECTION 2. This Act takes effect September 1, 2021.
