 A BILL TO BE ENTITLED
 AN ACT
 relating to a defense to prosecution for a handgun license holder
 who carries a handgun on certain premises.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 46.15, Penal Code, is amended by adding
 Subsection (n) to read as follows:
 (n)  It is a defense to prosecution under Sections 46.03(a)
 and 46.035(a-2), (a-3), (b), and (c) that:
 (1)  the person was carrying a handgun that the person
 was licensed to carry under Subchapter H, Chapter 411, Government
 Code, and no other weapon prohibited under the applicable section;
 and
 (2)  the license holder was personally given notice
 that carrying a handgun on the property was prohibited and promptly
 departed from the property.
 SECTION 2.  The change in law made by this Act applies only
 to an offense committed on or after the effective date of this Act.
 An offense committed before the effective date of this Act is
 governed by the law in effect on the date the offense was committed,
 and the former law is continued in effect for that purpose. For
 purposes of this section, an offense was committed before the
 effective date of this Act if any element of the offense occurred
 before that date.
 SECTION 3.  This Act takes effect September 1, 2021.
