10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Article 42A.751, Code of Criminal Procedure, is | |
12 | 12 | amended by adding Subsection (b-1) to read as follows: | |
13 | 13 | (b-1) Notwithstanding Subsection (b), the judge may not | |
14 | 14 | issue a warrant for a violation of a condition of community | |
15 | 15 | supervision solely because the results of a drug test taken by the | |
16 | 16 | defendant indicated that tetrahydrocannabinol or cannabidiol was | |
17 | 17 | present in the body of the defendant. | |
18 | 18 | SECTION 2. This Act takes effect September 1, 2021. |
