79 AN ACT
810 relating to the confidentiality of a full-time public school
911 employee's home or residence address in certain government records
1012 and documents.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Section 25.025(a), Tax Code, as amended by
1315 Chapters 467 (H.B. 4170), 469 (H.B. 4173), 633 (S.B. 1494), 1213
1416 (S.B. 662), and 1245 (H.B. 2446), Acts of the 86th Legislature,
1517 Regular Session, 2019, is reenacted and amended to read as follows:
1618 (a) This section applies only to:
1719 (1) a current or former peace officer as defined by
1820 Article 2.12, Code of Criminal Procedure, and the spouse or
1921 surviving spouse of the peace officer;
2022 (2) the adult child of a current peace officer as
2123 defined by Article 2.12, Code of Criminal Procedure;
2224 (3) a county jailer as defined by Section 1701.001,
2325 Occupations Code;
2426 (4) an employee of the Texas Department of Criminal
2527 Justice;
2628 (5) a commissioned security officer as defined by
2729 Section 1702.002, Occupations Code;
2830 (6) an individual who shows that the individual, the
2931 individual's child, or another person in the individual's household
3032 is a victim of family violence as defined by Section 71.004, Family
3133 Code, by providing:
3234 (A) a copy of a protective order issued under
3335 Chapter 85, Family Code, or a magistrate's order for emergency
3436 protection issued under Article 17.292, Code of Criminal Procedure;
3537 or
3638 (B) other independent documentary evidence
3739 necessary to show that the individual, the individual's child, or
3840 another person in the individual's household is a victim of family
3941 violence;
4042 (7) an individual who shows that the individual, the
4143 individual's child, or another person in the individual's household
4244 is a victim of sexual assault or abuse, stalking, or trafficking of
4345 persons by providing:
4446 (A) a copy of a protective order issued under
4547 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
4648 magistrate's order for emergency protection issued under Article
4749 17.292, Code of Criminal Procedure; or
4850 (B) other independent documentary evidence
4951 necessary to show that the individual, the individual's child, or
5052 another person in the individual's household is a victim of sexual
5153 assault or abuse, stalking, or trafficking of persons;
5254 (8) a participant in the address confidentiality
5355 program administered by the attorney general under Subchapter B,
5456 Chapter 58, Code of Criminal Procedure, who provides proof of
5557 certification under Article 58.059, Code of Criminal Procedure;
5658 (9) a federal judge, a state judge, or the spouse of a
5759 federal judge or state judge;
5860 (10) a current or former district attorney, criminal
5961 district attorney, or county or municipal attorney whose
6062 jurisdiction includes any criminal law or child protective services
6163 matters;
6264 (11) a current or former employee of a district
6365 attorney, criminal district attorney, or county or municipal
6466 attorney whose jurisdiction includes any criminal law or child
6567 protective services matters;
6668 (12) an officer or employee of a community supervision
6769 and corrections department established under Chapter 76,
6870 Government Code, who performs a duty described by Section 76.004(b)
6971 of that code;
7072 (13) a criminal investigator of the United States as
7173 described by Article 2.122(a), Code of Criminal Procedure;
7274 (14) a police officer or inspector of the United
7375 States Federal Protective Service;
7476 (15) a current or former United States attorney or
7577 assistant United States attorney and the spouse and child of the
7678 attorney;
7779 (16) a current or former employee of the office of the
7880 attorney general who is or was assigned to a division of that office
7981 the duties of which involve law enforcement;
8082 (17) a medical examiner or person who performs
8183 forensic analysis or testing who is employed by this state or one or
8284 more political subdivisions of this state;
8385 (18) a current or former member of the United States
8486 armed forces who has served in an area that the president of the
8587 United States by executive order designates for purposes of 26
8688 U.S.C. Section 112 as an area in which armed forces of the United
8789 States are or have engaged in combat;
8890 (19) a current or former employee of the Texas
8991 Juvenile Justice Department or of the predecessors in function of
9092 the department;
9193 (20) a current or former juvenile probation or
9294 supervision officer certified by the Texas Juvenile Justice
9395 Department, or the predecessors in function of the department,
9496 under Title 12, Human Resources Code;
9597 (21) a current or former employee of a juvenile
9698 justice program or facility, as those terms are defined by Section
9799 261.405, Family Code;
98100 (22) a current or former employee of the Texas Civil
99101 Commitment Office or the predecessor in function of the office or a
100102 division of the office; [and]
101103 (23) a current or former employee of a federal judge or
102104 state judge;
103105 (24) a current or former child protective services
104106 caseworker, adult protective services caseworker, or investigator
105107 for the Department of Family and Protective Services or a current or
106108 former employee of a department contractor performing child
107109 protective services caseworker, adult protective services
108110 caseworker, or investigator functions for the contractor on behalf
109111 of the department; [and]
110112 (25) [(24)] a state officer elected statewide or a
111113 member of the legislature;
112114 (26) [(24)] a firefighter or volunteer firefighter or
113115 emergency medical services personnel as defined by Section 773.003,
114116 Health and Safety Code; and
115117 (27) a full-time employee of a public school.
116118 SECTION 2. Section 521.121, Transportation Code, is amended
117119 by adding Subsection (d) to read as follows:
118120 (d) The department shall establish a procedure, on a showing
119121 of a license holder's full-time employment at a public school, to
120122 omit the residence address of the license holder on the license
121123 holder's license and to include, in lieu of that address, the street
122124 address of the public school.
123125 SECTION 3. To the extent of any conflict, this Act prevails
124126 over another Act of the 87th Legislature, Regular Session, 2021,
125127 relating to nonsubstantive additions to and corrections in enacted
126128 codes.
127129 SECTION 4. This Act takes effect September 1, 2021.
