7 | 7 | | relating to training requirements for a member of the board of |
---|
8 | 8 | | trustees and the superintendent of an independent school district |
---|
9 | 9 | | regarding cultural competence and implicit bias. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. Sections 11.159(c) and (e), Education Code, are |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | (c) The State Board of Education shall require a trustee to |
---|
14 | 14 | | complete every two years at least: |
---|
15 | 15 | | (1) three hours of training on evaluating student |
---|
16 | 16 | | academic performance; [and] |
---|
17 | 17 | | (2) one hour of training on identifying and reporting |
---|
18 | 18 | | potential victims of sexual abuse, human trafficking, and other |
---|
19 | 19 | | maltreatment of children; and |
---|
20 | 20 | | (3) two hours of training in cultural competence and |
---|
21 | 21 | | implicit bias. |
---|
22 | 22 | | (e) For purposes of this section: |
---|
23 | 23 | | (1) "Cultural competence" means the ability to address |
---|
24 | 24 | | the educational needs of individuals from diverse backgrounds |
---|
25 | 25 | | effectively by applying knowledge, empathy, and insight into the |
---|
26 | 26 | | views on education that those backgrounds present. |
---|
27 | 27 | | (2) "Implicit bias" means: |
---|
28 | 28 | | (A) bias in judgment or behavior that results |
---|
29 | 29 | | from subtle cognitive processes, including implicit attitudes and |
---|
30 | 30 | | implicit stereotypes, that often operate at a level below conscious |
---|
31 | 31 | | awareness and without intentional control; or |
---|
32 | 32 | | (B) implicit attitudes and stereotypes that |
---|
33 | 33 | | result in beliefs or simple associations that a person makes |
---|
34 | 34 | | between an object and its evaluation that are automatically |
---|
35 | 35 | | activated by the mere presence, actual or symbolic, of the attitude |
---|
36 | 36 | | object. |
---|
37 | 37 | | (3) "Other[, "other] maltreatment" has the meaning |
---|
38 | 38 | | assigned by Section 42.002, Human Resources Code. |
---|
39 | 39 | | SECTION 2. Section 21.054, Education Code, is amended by |
---|
40 | 40 | | amending Subsection (h) and adding Subsection (h-1) to read as |
---|
41 | 41 | | follows: |
---|
42 | 42 | | (h) Continuing education requirements for a superintendent |
---|
43 | 43 | | must include at least: |
---|
44 | 44 | | (1) 2-1/2 hours of training every five years on |
---|
45 | 45 | | identifying and reporting potential victims of sexual abuse, human |
---|
46 | 46 | | trafficking, and other maltreatment of children; and |
---|
47 | 47 | | (2) two hours of training every five years in cultural |
---|
48 | 48 | | competence and implicit bias. |
---|
49 | 49 | | (h-1) For purposes of this section: |
---|
50 | 50 | | (1) "Cultural competence" and "implicit bias" have the |
---|
51 | 51 | | meanings assigned by Section 11.159. |
---|
52 | 52 | | (2) "Other [this subsection, "other] maltreatment" |
---|
53 | 53 | | has the meaning assigned by Section 42.002, Human Resources Code. |
---|
54 | 54 | | SECTION 3. A superintendent subject to continuing education |
---|
55 | 55 | | requirements immediately before the effective date of this Act is |
---|
56 | 56 | | not required to comply with the continuing education requirements |
---|
57 | 57 | | described by Section 21.054(h), Education Code, as amended by this |
---|
58 | 58 | | Act, for any continuing education requirements period that ends |
---|
59 | 59 | | before January 1, 2023. |
---|
60 | 60 | | SECTION 4. This Act takes effect September 1, 2021. |
