55 AN ACT
66 relating to online learning programs offered by a school district
77 or open-enrollment charter school to students enrolled at a campus

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 29, Education Code, is
1111 amended by adding Section 29.9091 to read as follows:
1212 Sec. 29.9091. ONLINE LEARNING PROGRAMS. (a) In this
1313 section, "electronic course" has the meaning assigned by Section
1414 30A.001.
1515 (b) A school district or open-enrollment charter school may
1616 establish an online learning program to offer electronic courses
1717 that satisfy the curriculum requirements under Section 28.002 to
1818 students enrolled in any grade level from kindergarten through
1919 grade 12 at a campus of the district or school.
2020 (c) The board of trustees of a school district or the
2121 governing body of an open-enrollment charter school that operates
2222 an online learning program under this section may establish
2323 eligibility criteria for students to enroll in electronic courses
2424 offered through the program. In establishing criteria, a board of
2525 trustees or governing body may limit student enrollment in
2626 electronic courses to encourage instruction in a traditional
2727 classroom setting. For eligible students, the board of trustees or
2828 governing body may:
2929 (1) limit the number of electronic courses in which
3030 the student may enroll; or
3131 (2) allow students to enroll full-time in the online
3232 learning program.
3333 (d) A school district or open-enrollment charter school
3434 that operates a program under this section is entitled to funding
3535 under Chapter 48 or in accordance with the terms of a charter
3636 granted under Section 12.101 for the student's enrollment in an
3737 electronic course offered through the program in the same manner
3838 the district or school is entitled to funding for the student's
3939 enrollment in courses provided in a traditional classroom setting,
4040 provided the student successfully completes the electronic course.
4141 (e) A school district or open-enrollment charter school may
4242 calculate the average daily attendance of a student enrolled in the
4343 program based on:
4444 (1) hours of contact with the student;
4545 (2) the student's successful completion of a course;
4646 or
4747 (3) a method approved by the commissioner.
4848 SECTION 2. This Act applies beginning with the 2021-2022
4949 school year.
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2021.
