66 AN ACT
77 relating to the requirement that a ballot to be voted by mail be
88 canceled and returned before voting in person.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 84.031, Election Code, is amended by
1111 amending Subsection (b) and adding Subsection (c) to read as
1212 follows:
1313 (b) A person whose application is canceled by returning the
1414 person's ballot in accordance with Section 84.032, if otherwise
1515 eligible, may vote in the same manner as if the application had not
1616 been submitted.
1717 (c) A person whose application is canceled in any other
1818 manner may cast a provisional ballot under Section 63.011.
1919 SECTION 2. Section 84.032, Election Code, is amended by
2020 adding Subsections (g), (h), and (i) to read as follows:
2121 (g) The early voting clerk shall deliver each request for
2222 cancellation to the early voting ballot board to ensure a canceled
2323 ballot is not counted.
2424 (h) The early voting clerk and presiding election judge
2525 shall keep a log of each ballot returned and shall provide a copy of
2626 the log to the early voting ballot board to ensure that the canceled
2727 ballot is not counted in the election. Returned ballots must be kept
2828 in a secure container with a chain of custody maintained by the
2929 early voting clerk.
3030 (i) The log under Subsection (h) shall include for each
3131 entry:
3232 (1) the voter's name;
3333 (2) an identification number unique to the voter;
3434 (3) the voter's signature; and
3535 (4) the date and time the application was returned.
3636 SECTION 3. Section 84.033, Election Code, is amended by
3737 adding Subsection (e) to read as follows:
3838 (e) The election officer shall electronically submit a
3939 record to the secretary of state of each application canceled in a
4040 primary, a runoff primary, a general election, or any special
4141 election ordered by the governor on the day the application is
4242 canceled.
4343 SECTION 4. This Act takes effect September 1, 2021.
