77 relating to an application for ballot to be voted by mail submitted
88 by telephonic facsimile machine or electronic transmission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 84.007(b-1), Election Code, is amended
1111 to read as follows:
1212 (b-1) For an application for ballot by mail submitted by
1313 telephonic facsimile machine or electronic transmission to be
1414 effective, the application also must be submitted by mail and be
1515 received by the early voting clerk not later than the seventh
1616 [fourth] business day before the date of the election for which the
1717 ballot is requested [after the transmission by telephonic facsimile
1818 machine or electronic transmission is received].
1919 SECTION 2. The change in law made by this Act applies only
2020 to an application for a ballot to be voted by mail submitted on or
2121 after the effective date of this Act. An application for a ballot
2222 to be voted by mail submitted before the effective date of this Act
2323 is governed by the law in effect when the application was submitted,
2424 and the former law is continued in effect for that purpose.
2525 SECTION 3. This Act takes effect September 1, 2021.
