9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 84.007(b-1), Election Code, is amended | |
11 | 11 | to read as follows: | |
12 | 12 | (b-1) For an application for ballot by mail submitted by | |
13 | 13 | telephonic facsimile machine or electronic transmission to be | |
14 | 14 | effective, the application also must be submitted by mail and be | |
15 | 15 | received by the early voting clerk not later than the seventh | |
16 | 16 | [fourth] business day before the date of the election for which the | |
17 | 17 | ballot is requested [after the transmission by telephonic facsimile | |
18 | 18 | machine or electronic transmission is received]. | |
19 | 19 | SECTION 2. The change in law made by this Act applies only | |
20 | 20 | to an application for a ballot to be voted by mail submitted on or | |
21 | 21 | after the effective date of this Act. An application for a ballot | |
22 | 22 | to be voted by mail submitted before the effective date of this Act | |
23 | 23 | is governed by the law in effect when the application was submitted, | |
24 | 24 | and the former law is continued in effect for that purpose. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
