10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 420.045, Government Code, is amended to | |
12 | 12 | read as follows: | |
13 | 13 | Sec. 420.045. REPORT OF UNANALYZED EVIDENCE OF SEXUAL | |
14 | 14 | ASSAULT OR OTHER SEX OFFENSE. (a) In this section: | |
15 | 15 | (1) "Backlog kit" means an evidence collection kit | |
16 | 16 | that has been in the possession of a public accredited crime | |
17 | 17 | laboratory for more than 90 days. | |
18 | 18 | (2) "Unsubmitted kit" means an evidence collection kit | |
19 | 19 | in a law enforcement agency's possession that has not yet been | |
20 | 20 | submitted to a public accredited crime laboratory. | |
21 | 21 | (b) Each law enforcement agency [and public accredited | |
22 | 22 | crime laboratory] shall submit a quarterly report to the department | |
23 | 23 | identifying the number of unsubmitted kits in the law enforcement | |
24 | 24 | agency's possession. | |
25 | 25 | (c) Each public accredited crime laboratory shall submit a | |
26 | 26 | quarterly report to the department identifying the number of | |
27 | 27 | evidence collection kits [that the law enforcement agency has not | |
28 | 28 | yet submitted for laboratory analysis or] for which the crime | |
29 | 29 | laboratory has not yet completed an analysis, including the number | |
30 | 30 | of those evidence collection kits that are backlog kits [as | |
31 | 31 | applicable]. | |
32 | 32 | SECTION 2. This Act takes effect September 1, 2021. |
