55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to public school accountability.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 39.053, Education Code, is amended by
1010 amending Subsection (c) and adding Subsection (c-4) to read as
1111 follows:
1212 (c) School districts and campuses must be evaluated based on
1313 four [three] domains of indicators of achievement adopted under
1414 this section that include:
1515 (1) in the student achievement domain, indicators of
1616 student achievement that must include:
1717 (A) for evaluating the performance of districts
1818 and campuses generally:
1919 (i) an indicator that accounts for the
2020 results of assessment instruments required under Sections
2121 39.023(a), (c), and (l), as applicable for the district and campus,
2222 including the results of assessment instruments required for
2323 graduation retaken by a student, aggregated across grade levels by
2424 subject area, including:
2525 (a) for the performance standard
2626 determined by the commissioner under Section 39.0241(a), the
2727 percentage of students who performed satisfactorily on the
2828 assessment instruments, aggregated across grade levels by subject
2929 area; and
3030 (b) for the college readiness
3131 performance standard as determined under Section 39.0241, the
3232 percentage of students who performed satisfactorily on the
3333 assessment instruments, aggregated across grade levels by subject
3434 area; and
3535 (ii) an indicator that accounts for the
3636 results of assessment instruments required under Section
3737 39.023(b), as applicable for the district and campus, including the
3838 percentage of students who performed satisfactorily on the
3939 assessment instruments, as determined by the performance standard
4040 adopted by the agency, aggregated across grade levels by subject
4141 area; and
4242 (B) for evaluating the performance of high school
4343 campuses and districts that include high school campuses,
4444 indicators that account for:
4545 (i) students who satisfy the Texas Success
4646 Initiative (TSI) college readiness benchmarks prescribed by the
4747 Texas Higher Education Coordinating Board under Section 51.334 on
4848 an assessment instrument in reading or mathematics designated by
4949 the coordinating board under that section;
5050 (ii) students who satisfy relevant
5151 performance standards on advanced placement tests or similar
5252 assessments;
5353 (iii) students who earn dual course credits
5454 in the dual credit courses;
5555 (iv) students who enlist in the armed
5656 forces of the United States;
5757 (v) students who earn industry
5858 certifications;
5959 (vi) students admitted into postsecondary
6060 industry certification programs that require as a prerequisite for
6161 entrance successful performance at the secondary level;
6262 (vii) students whose successful completion
6363 of a course or courses under Section 28.014 indicates the student's
6464 preparation to enroll and succeed, without remediation, in an
6565 entry-level general education course for a baccalaureate degree or
6666 associate degree;
6767 (viii) students who successfully met
6868 standards on a composite of indicators that through research
6969 indicates the student's preparation to enroll and succeed, without
7070 remediation, in an entry-level general education course for a
7171 baccalaureate degree or associate degree;
7272 (ix) high school graduation rates, computed
7373 in accordance with standards and definitions adopted in compliance
7474 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
7575 subject to the exclusions provided by Subsections (g), (g-1),
7676 (g-2), and (g-3);
7777 (x) students who successfully completed an
7878 OnRamps dual enrollment course;
7979 (xi) students who successfully completed a
8080 practicum or internship approved by the State Board of Education;
8181 and
8282 (xii) students who are awarded an associate
8383 degree;
8484 (2) in the school progress domain, indicators for
8585 effectiveness in promoting student learning, which must include:
8686 (A) for assessment instruments, including
8787 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
8888 percentage of students who met the standard for improvement, as
8989 determined by the commissioner; and
9090 (B) for evaluating relative performance, the
9191 performance of districts and campuses compared to similar districts
9292 or campuses; [and]
9393 (3) in the closing the gaps domain, the use of
9494 disaggregated data to demonstrate the differentials among students
9595 from different racial and ethnic groups, socioeconomic
9696 backgrounds, and other factors, including:
9797 (A) students formerly receiving special
9898 education services;
9999 (B) students continuously enrolled; and
100100 (C) students who are mobile; and
101101 (4) in the school portfolio domain for evaluating the
102102 performance of districts and campuses generally, indicators of
103103 school portfolio, which must include:
104104 (A) students who successfully complete courses
105105 in fine arts, physical education, or a language other than English,
106106 or other courses included in the enrichment curriculum under
107107 Section 28.002(a)(2);
108108 (B) students who participate in extracurricular
109109 activities, including University Interscholastic League activities
110110 such as academic, fine arts, and athletic events and foreign
111111 language, chess, and robotics clubs;
112112 (C) students who successfully complete the
113113 distinguished level of achievement under Section 28.025(b-7);
114114 (D) students who successfully complete at least
115115 one endorsement under Section 28.025(c-1);
116116 (E) students who successfully complete a
117117 coherent sequence of fine arts courses;
118118 (F) students who successfully complete a
119119 character education program provided under Section 29.906;
120120 (G) educationally disadvantaged students who
121121 successfully complete a postsecondary readiness course;
122122 (H) results from the school and student safety
123123 survey of districts and campuses administered under Section
124124 39.0531;
125125 (I) efforts by districts and campuses relating to
126126 increasing teacher retention, including providing mentoring
127127 programs and professional development opportunities;
128128 (J) health and wellness as determined by the
129129 commissioner in consultation with the State Board of Education and
130130 any appropriate advisory committees;
131131 (K) for campuses that serve students enrolled in
132132 prekindergarten, an indicator that accounts for student
133133 participation in full-day prekindergarten programs;
134134 (L) students in grades five, six, seven, and
135135 eight who earn credit for advanced courses;
136136 (M) students enrolled in grade nine for the first
137137 time who earn the credits required during that school year for
138138 promotion to the next grade level; and
139139 (N) students who are absent, as defined by
140140 Subsection (c-4), fewer than 15 days during the current school
141141 year.
142142 (c-4) In Subsection (c)(4)(N), "absent" means the student
143143 is not physically on school grounds and is not participating in
144144 instruction or instruction-related activities at an approved
145145 off-campus location for the school day, without regard to whether
146146 the absence is excused or unexcused.
147147 SECTION 2. Subchapter C, Chapter 39, Education Code, is
148148 amended by adding Section 39.0531 to read as follows:
149149 Sec. 39.0531. SCHOOL AND STUDENT SAFETY SURVEY. (a) The
150150 commissioner may incorporate a school and student safety survey as
151151 an indicator for the portfolio domain under Section 39.053(c)(4).
152152 A school and student safety survey shall be administered to
153153 administrators and teachers employed by school districts, students
154154 enrolled in school districts, and parents of those students.
155155 (b) The commissioner may adopt rules to implement this
156156 section, including rules to:
157157 (1) determine the format of the survey;
158158 (2) determine the questions that the survey must
159159 include;
160160 (3) establish a period during a school year in which
161161 the survey must be conducted;
162162 (4) establish requirements for administering and
163163 reporting the results of the survey; and
164164 (5) authorize the manner in which the survey may be
165165 administered, including the local administration of the survey.
166166 (c) Notwithstanding any other provision of this code,
167167 including Section 21.355, school and student safety survey
168168 information must be reported to the agency in accordance with rules
169169 adopted by the commissioner.
170170 (d) The commissioner may contract with a third party to
171171 provide any service necessary under this section.
172172 SECTION 3. Section 39.054(a-1), Education Code, is amended
173173 to read as follows:
174174 (a-1) For purposes of assigning an overall performance
175175 rating for a district or campus under Subsection (a), the
176176 commissioner shall:
177177 (1) consider either the district's or campus's
178178 performance rating under the student achievement domain under
179179 Section 39.053(c)(1) or the school progress domain under Section
180180 39.053(c)(2), whichever performance rating is higher, unless the
181181 district or campus received a performance rating of F in either
182182 domain, in which case the district or campus may not be assigned a
183183 performance rating higher than a B for the composite for the two
184184 domains; [and]
185185 (2) attribute not less than 30 percent of the
186186 performance rating to the closing the gaps domain under Section
187187 39.053(c)(3); and
188188 (3) attribute not less than 20 percent of the
189189 performance rating to the school portfolio domain under Section
190190 39.053(c)(4).
191191 SECTION 4. This Act takes effect immediately if it receives
192192 a vote of two-thirds of all the members elected to each house, as
193193 provided by Section 39, Article III, Texas Constitution. If this
194194 Act does not receive the vote necessary for immediate effect, this
195195 Act takes effect September 1, 2021.
