55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the criminal penalty for reckless driving and to the
88 limitation on the authority to arrest a person for certain traffic
99 offenses punishable by fine only.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 543.004(a), Transportation Code, is
1212 amended to read as follows:
1313 (a) An officer shall issue a written notice to appear if:
1414 (1) the offense charged is:
1515 (A) speeding;
1616 (B) the use of a wireless communication device
1717 under Section 545.4251; [or]
1818 (C) a violation of the open container law,
1919 Section 49.031, Penal Code;
2020 (D) a violation of signaling requirements under
2121 Section 545.104, 545.105, 545.106, or 545.107; or
2222 (E) reckless driving under Section 545.401, if
2323 the offense is punishable by a fine only; and
2424 (2) the person makes a written promise to appear in
2525 court as provided by Section 543.005.
2626 SECTION 2. Section 545.401, Transportation Code, is amended
2727 by amending Subsection (b) and adding Subsection (b-1) to read as
2828 follows:
2929 (b) Except as provided by Subsection (b-1), an offense under
3030 this section is a misdemeanor punishable by a fine not to exceed
3131 $200.
3232 (b-1) If an [An] offense under this section resulted in
3333 bodily injury or property damage, the offense is a misdemeanor
3434 punishable by:
3535 (1) a fine not to exceed $200;
3636 (2) confinement in county jail for not more than 30
3737 days; or
3838 (3) both the fine and the confinement.
3939 SECTION 3. The change in law made by this Act applies only
4040 to an offense committed on or after the effective date of this Act.
4141 An offense committed before the effective date of this Act is
4242 governed by the law in effect on the date the offense was committed,
4343 and the former law is continued in effect for that purpose. For
4444 purposes of this section, an offense was committed before the
4545 effective date of this Act if any element of the offense occurred
4646 before that date.
4747 SECTION 4. This Act takes effect September 1, 2021.
