55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the certificate of merit required for certain civil
88 actions against certain licensed or registered professionals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 150.002, Civil Practice and Remedies
1111 Code, is amended by adding Subsection (b-1) to read as follows:
1212 (b-1) The affidavit shall set forth specifically facts
1313 sufficient to establish the affiant's familiarity or experience
1414 with the relevant practice area such that the affiant's
1515 qualifications to render an opinion on the matters set forth in the
1616 affidavit for purposes of Subsection (b) are established. The
1717 affiant must attach to the affidavit as an exhibit the affiant's
1818 curriculum vitae or a similar document sufficient to establish that
1919 the affiant meets the requirements of Subsection (a).
2020 SECTION 2. The change in law made by this Act applies only
2121 to an action commenced on or after the effective date of this Act.
2222 An action commenced before the effective date of this Act is
2323 governed by the law as it existed immediately before the effective
2424 date of this Act, and that law is continued in effect for that
2525 purpose.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2021.
