55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the salary and wages paid to public school employees;
88 making an appropriation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.402, Education Code, is amended by
1111 adding Subsections (c-2), (c-3), and (d) and amending Subsection
1212 (g) to read as follows:
1313 (c-2) Notwithstanding Subsection (a), for the 2021-2022
1414 school year, a classroom teacher, full-time librarian, full-time
1515 school counselor certified under Subchapter B, or full-time school
1616 nurse is entitled to a monthly salary that is at least equal to the
1717 sum of:
1818 (1) the monthly salary the employee would have
1919 received for the 2021-2022 school year under the district's salary
2020 schedule for the 2020-2021 school year, if that schedule had been in
2121 effect for the 2021-2022 school year, including any local
2222 supplement and any money representing a career ladder supplement
2323 the employee would have received in the 2021-2022 school year; and
2424 (2) $400.
2525 (c-3) Subsection (c-2) and this subsection expire September
2626 1, 2022.
2727 (d) A classroom teacher, full-time librarian, full-time
2828 school counselor certified under Subchapter B, or full-time school
2929 nurse employed by a school district in the 2021-2022 school year is,
3030 as long as the employee is employed by the same district, entitled
3131 to a salary that is at least equal to the salary the employee
3232 received for the 2021-2022 school year.
3333 (g) The commissioner may adopt rules to govern the
3434 application of this section, including rules that:
3535 (1) require the payment of a minimum salary under this
3636 section to a person employed in more than one capacity for which a
3737 minimum salary is provided and whose combined employment in those
3838 capacities constitutes full-time employment; and
3939 (2) specify the credentials a person must hold to be
4040 considered a [speech pathologist or] school nurse under this
4141 section.
4242 SECTION 2. Subchapter F, Chapter 48, Education Code, is
4343 amended by adding Section 48.2521 to read as follows:
4444 Sec. 48.2521. ADDITIONAL STATE AID FOR SALARY INCREASES FOR
4545 CERTAIN PROFESSIONAL EMPLOYEES. (a) A school district, including
4646 a school district that is otherwise ineligible for state aid under
4747 this chapter, is entitled to state aid in an amount equal to the
4848 product of $4,000 multiplied by the number of classroom teachers,
4949 full-time librarians, full-time school counselors certified under
5050 Subchapter B, Chapter 21, and full-time school nurses employed by
5151 the district.
5252 (b) The commissioner may adopt rules to implement this
5353 section.
5454 SECTION 3. (a) The amount of $1 billion is appropriated
5555 from the economic stabilization fund to the foundation school fund
5656 for distribution by the commissioner of education during the state
5757 fiscal biennium beginning September 1, 2021, to school districts to
5858 provide one-time retention bonuses to district support staff.
5959 (b) The commissioner of education shall distribute the
6060 amount appropriated under this section to school districts on the
6161 basis of the number of full-time district employees, other than
6262 administrators and employees subject to the minimum salary schedule
6363 under Section 21.402, Education Code.
6464 (c) Each school district may use funds distributed under
6565 this section only to increase the salary that would otherwise be
6666 provided to district employees described by Subsection (b) of this
6767 section.
6868 (d) This section takes effect only if this Act is approved
6969 by a vote of two-thirds of the members present in each house of the
7070 legislature, as provided by Section 49-g(m), Article III, Texas
7171 Constitution.
7272 SECTION 4. Section 21.402(c-1), Education Code, is
7373 repealed.
7474 SECTION 5. This Act applies beginning with the 2021-2022
7575 school year.
7676 SECTION 6. Except as otherwise provided by this Act, this
7777 Act takes effect September 1, 2021.
