5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to an indicator of achievement for evaluating the
8	8	performance of public elementary, middle school, and junior high
9	9	campuses and districts under the public school accountability
10	10	system.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 39.053, Education Code, is amended by
13	13	amending Subsection (c) and adding Subsection (c-4) to read as
14	14	follows:
15	15	(c) School districts and campuses must be evaluated based on
16	16	three domains of indicators of achievement adopted under this
17	17	section that include:
18	18	(1) in the student achievement domain, indicators of
19	19	student achievement that must include:
20	20	(A) for evaluating the performance of districts
21	21	and campuses generally:
22	22	(i) an indicator that accounts for the
23	23	results of assessment instruments required under Sections
24	24	39.023(a), (c), and (l), as applicable for the district and campus,
25	25	including the results of assessment instruments required for
26	26	graduation retaken by a student, aggregated across grade levels by
27	27	subject area, including:
28	28	(a) for the performance standard
29	29	determined by the commissioner under Section 39.0241(a), the
30	30	percentage of students who performed satisfactorily on the
31	31	assessment instruments, aggregated across grade levels by subject
32	32	area; and
33	33	(b) for the college readiness
34	34	performance standard as determined under Section 39.0241, the
35	35	percentage of students who performed satisfactorily on the
36	36	assessment instruments, aggregated across grade levels by subject
37	37	area; and
38	38	(ii) an indicator that accounts for the
39	39	results of assessment instruments required under Section
40	40	39.023(b), as applicable for the district and campus, including the
41	41	percentage of students who performed satisfactorily on the
42	42	assessment instruments, as determined by the performance standard
43	43	adopted by the agency, aggregated across grade levels by subject
44	44	area; [and]
45	45	(A-1) for evaluating the performance of
46	46	elementary, middle school, and junior high campuses and districts
47	47	that include those campuses, an indicator that accounts for
48	48	improving student preparedness for success in subsequent grade
49	49	levels that is measured by meeting standards, adopted by
50	50	commissioner rule, other than performance on assessment
51	51	instruments;
52	52	(B) for evaluating the performance of high school
53	53	campuses and districts that include high school campuses,
54	54	indicators that account for:
55	55	(i) students who satisfy the Texas Success
56	56	Initiative (TSI) college readiness benchmarks prescribed by the
57	57	Texas Higher Education Coordinating Board under Section 51.334 on
58	58	an assessment instrument in reading or mathematics designated by
59	59	the coordinating board under that section;
60	60	(ii) students who satisfy relevant
61	61	performance standards on advanced placement tests or similar
62	62	assessments;
63	63	(iii) students who earn dual course credits
64	64	in the dual credit courses;
65	65	(iv) students who enlist in the armed
66	66	forces of the United States;
67	67	(v) students who earn industry
68	68	certifications;
69	69	(vi) students admitted into postsecondary
70	70	industry certification programs that require as a prerequisite for
71	71	entrance successful performance at the secondary level;
72	72	(vii) students whose successful completion
73	73	of a course or courses under Section 28.014 indicates the student's
74	74	preparation to enroll and succeed, without remediation, in an
75	75	entry-level general education course for a baccalaureate degree or
76	76	associate degree;
77	77	(viii) students who successfully met
78	78	standards on a composite of indicators that through research
79	79	indicates the student's preparation to enroll and succeed, without
80	80	remediation, in an entry-level general education course for a
81	81	baccalaureate degree or associate degree;
82	82	(ix) high school graduation rates, computed
83	83	in accordance with standards and definitions adopted in compliance
84	84	with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
85	85	subject to the exclusions provided by Subsections (g), (g-1),
86	86	(g-2), and (g-3);
87	87	(x) students who successfully completed an
88	88	OnRamps dual enrollment course;
89	89	(xi) students who successfully completed a
90	90	practicum or internship approved by the State Board of Education;
91	91	and
92	92	(xii) students who are awarded an associate
93	93	degree;
94	94	(2) in the school progress domain, indicators for
95	95	effectiveness in promoting student learning, which must include:
96	96	(A) for assessment instruments, including
97	97	assessment instruments under Subdivisions (1)(A)(i) and (ii), the
98	98	percentage of students who met the standard for improvement, as
99	99	determined by the commissioner; and
100	100	(B) for evaluating relative performance, the
101	101	performance of districts and campuses compared to similar districts
102	102	or campuses; and
103	103	(3) in the closing the gaps domain, the use of
104	104	disaggregated data to demonstrate the differentials among students
105	105	from different racial and ethnic groups, socioeconomic
106	106	backgrounds, and other factors, including:
107	107	(A) students formerly receiving special
108	108	education services;
109	109	(B) students continuously enrolled; and
110	110	(C) students who are mobile.
111	111	(c-4) In evaluating the performance of elementary, middle
112	112	school, and junior high campuses and districts that include those
113	113	campuses in the student achievement domain, the commissioner shall
114	114	give equal weight to the indicator:
115	115	(1) adopted by the commissioner under Subsection
116	116	(c)(1)(A-1); and
117	117	(2) under Subsection (c)(1)(A)(i)(a) that accounts
118	118	for the results of assessment instruments.
119	119	SECTION 2. This Act applies beginning with the 2021-2022
120	120	school year.
121	121	SECTION 3. This Act takes effect immediately if it receives
122	122	a vote of two-thirds of all the members elected to each house, as
123	123	provided by Section 39, Article III, Texas Constitution. If this
124	124	Act does not receive the vote necessary for immediate effect, this
125	125	Act takes effect September 1, 2021.
