106 relating to establishing the Texas Commission on Community College
117 Finance.
128 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
139 SECTION 1. Subchapter G, Chapter 130, Education Code, is
1410 amended by adding Section 130.1305 to read as follows:
1511 Sec. 130.1305. TEXAS COMMISSION ON COMMUNITY COLLEGE
1612 FINANCE. (a) The Texas Commission on Community College Finance is
1713 established to make recommendations for consideration by the 88th
1814 Texas Legislature regarding the state funding formula and funding
1915 levels for public junior colleges in Texas that would be sufficient
2016 to sustain viable junior college education and training offerings
21- throughout the state and improve student outcomes in alignment with
22- state postsecondary goals.
23- (b) The commission is composed of 12 members as follows:
24- (1) four members appointed by the governor;
17+ throughout the state.
18+ (b) The commission is composed of 11 members as follows:
19+ (1) three members appointed by the governor;
2520 (2) three members appointed by the lieutenant
2621 governor;
2722 (3) three members appointed by the speaker of the
2823 house of representatives;
2924 (4) one member appointed by the board of the Texas
3025 Association of Community Colleges; and
3126 (5) one member appointed by the board of the Community
3227 College Association of Texas Trustees.
33- (c) One of the members appointed by the governor must be a
34- faculty member at a public junior college as defined by Section
35- 61.003, and the other members appointed by the governor must be
28+ (c) Members appointed by the governor must be
3629 representatives of junior college leaders, business leaders, or
3730 other stakeholders knowledgeable in junior college mission,
3831 instructional programs, and finance.
3932 (d) Members appointed by the lieutenant governor shall
4033 consist of:
41- (1) two members of the senate; and
42- (2) an administrator from a public junior college as
43- defined by Section 61.003.
44- (e) Members appointed by the speaker of the house of
45- representatives shall consist of:
34+ (1) two members of the Texas Senate; and
35+ (2) an administrator from an institution of higher
36+ education as defined by Section 61.003.
37+ (e) Members appointed by the speaker of the house shall
38+ consist of:
4639 (1) two members of the house of representatives; and
47- (2) an administrator from a public junior college as
48- defined by Section 61.003.
40+ (2) an administrator from an institution of higher
41+ education as defined by Section 61.003.
4942 (f) In making appointments, the governor, lieutenant
5043 governor, and speaker of the house of representatives shall
5144 coordinate to ensure that the membership of the commission
5245 reflects, to the extent possible, the geographic diversity of Texas
5346 public junior colleges and the ethnic diversity of the communities
5447 served by those junior colleges.
55- (g) The commission shall convene not later than October 15,
56- 2021, and shall continue its activities until completion of a final
57- report.
48+ (g) The commission shall convene not later than the 90th day
49+ after the enactment of this section by the legislature and shall
50+ continue its activities until completion of a final report.
5851 (h) The commission shall examine trend and forecast data,
59- seek stakeholder input, and account for equity in student outcomes
60- and based on its findings, make recommendations on:
61- (1) the components of state funding for public junior
62- colleges, including contact hour funding formulas established for
52+ seek stakeholder input, and account for equity in student outcomes,
53+ with a particular focus on students who are underrepresented in
54+ higher education, including from families in the bottom quintiles
55+ of the economic spectrum, and make recommendations on the following
56+ policies:
57+ (1) contact hour funding formulas established for
6358 public junior colleges under Subchapter C, Chapter 61, and
64- Subchapter A of this chapter; and
65- (2) the feasibility of establishing shared service
66- agreements or interinstitutional collaborations through which
67- institutions of higher education may perform administrative
68- services, other than direct instruction and student support
69- services, for other institutions of higher education for a fee or
70- other consideration.
59+ Subchapter A of this chapter;
60+ (2) the use of student success points established
61+ under Section 61.0593 to determine the allocation of state funding
62+ to public junior colleges;
63+ (3) historical or innovative funding methods for
64+ supporting underfunded colleges;
65+ (4) revenue source proportionality in the payment of
66+ employee group insurance benefits; and
67+ (5) the feasibility of establishing shared service
68+ agreements or interinstitutional collaboratives where institutions
69+ of higher education perform administrative services, other than
70+ direct instruction and student support services, for other
71+ institutions of higher education for a fee or other consideration.
7172 (i) The commission may seek resource support, including
7273 data analyses and technical assistance, from the Texas Higher
7374 Education Coordinating Board, the Texas Association of Community
7475 Colleges, and research organizations. The commission may accept
7576 gifts, grants, and donations from any source to be used to carry out
7677 a function of the commission.
7778 (j) The commission shall submit a final report and
7879 recommendations to the governor, lieutenant governor, and both
7980 houses of the legislature not later than November 1, 2022.
8081 (k) This section expires January 1, 2023.
81- SECTION 2. This Act takes effect September 1, 2021.
82+ SECTION 2. This Act takes effect immediately if it receives
83+ a vote of two-thirds of all the members elected to each house, as
84+ provided by Section 39, Article III, Texas Constitution. If this
85+ Act does not receive the vote necessary for immediate effect, this
86+ Act takes effect September 1, 2021.
