77 relating to the intake and disposition records of animal shelters
88 and releasing agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 823, Health and Safety
1111 Code, is amended to read as follows:
1212 CHAPTER 823. ANIMAL SHELTERS AND RELEASING AGENCIES
1313 SECTION 2. Section 823.001, Health and Safety Code, is
1414 amended by adding Subdivision (5) to read as follows:
1515 (5) "Releasing agency" has the meaning assigned by
1616 Section 828.001.
1717 SECTION 3. Section 823.002, Health and Safety Code, is
1818 amended to read as follows:
1919 Sec. 823.002. EXEMPTION FOR CERTAIN COUNTIES, CLINICS, AND
2020 FACILITIES. Except as provided by Sections 823.003(e) and 823.010,
2121 this [This] chapter does not apply to:
2222 (1) a county having a population of less than 75,000;
2323 (2) a veterinary medicine clinic; or
2424 (3) a livestock commission facility.
2525 SECTION 4. The heading to Section 823.003, Health and
2626 Safety Code, is amended to read as follows:
2727 Sec. 823.003. STANDARDS FOR ANIMAL SHELTERS AND RELEASING
2828 AGENCIES; CRIMINAL PENALTY.
2929 SECTION 5. Section 823.003(e), Health and Safety Code, is
3030 amended to read as follows:
3131 (e) The executive commissioner of the Health and Human
3232 Services Commission shall [may] require each person operating an
3333 animal shelter or releasing agency to keep the records required by
3434 Section 823.010. The executive commissioner shall require the
3535 shelter or agency [of the date and disposition of animals in its
3636 custody,] to maintain the records on the business premises of the
3737 [animal] shelter or agency[,] and to make the records available for
3838 inspection at reasonable times.
3939 SECTION 6. Chapter 823, Health and Safety Code, is amended
4040 by adding Section 823.010 to read as follows:
4141 Sec. 823.010. INTAKE AND DISPOSITION RECORDS FOR ANIMAL
4242 SHELTERS AND RELEASING AGENCIES. (a) Each animal shelter,
4343 including a shelter operated by a municipality, or releasing agency
4444 operated in this state shall prepare and maintain records on the
4545 intake and disposition of animals in the care of the shelter or
4646 agency, including:
4747 (1) the total number of live animals taken in by the
4848 shelter or agency, categorized by species and age;
4949 (2) the reason an animal was taken in by the shelter or
5050 agency, including whether the animal was:
5151 (A) surrendered by the animal's owner;
5252 (B) surrendered by the animal's owner and the
5353 owner requested that the animal be euthanized;
5454 (C) impounded as a stray animal or an animal at
5555 large;
5656 (D) confiscated;
5757 (E) transferred to the shelter or agency from a
5858 location in this state;
5959 (F) transferred to the shelter or agency from a
6060 location outside this state; or
6161 (G) born in the shelter or under the care of the
6262 agency;
6363 (3) the number of animals at the shelter or agency on
6464 the last day of each month, categorized by species and age; and
6565 (4) the disposition of each animal taken in by the
6666 shelter or agency, categorized by species and age, including
6767 whether the animal:
6868 (A) was adopted;
6969 (B) was reclaimed by the animal's owner;
7070 (C) died in the shelter or under the care of the
7171 agency;
7272 (D) was transferred from the shelter or agency;
7373 (E) was euthanized by the shelter or agency on a
7474 decision made by the shelter or agency;
7575 (F) was euthanized at the owner's request;
7676 (G) was returned to the field as part of a
7777 sterilization program; or
7878 (H) was lost or stolen while in the shelter's or
7979 agency's care.
8080 (b) In the records required by Subsection (a), an animal
8181 shelter or releasing agency must use the following categories:
8282 (1) for species, dog, cat, or other; and
8383 (2) for age, up to five months or adult.
8484 (c) An animal shelter or releasing agency monthly shall
8585 prepare the records required by Subsection (a).
8686 (d) An animal shelter or releasing agency shall maintain
8787 records prepared under Subsection (a) until at least the third
8888 anniversary of the date the record was prepared.
8989 (e) An animal shelter or releasing agency shall make the
9090 records required by this section available to the public by:
9191 (1) posting the records on the shelter's,
9292 municipality's, or agency's Internet website; or
9393 (2) for a shelter, municipality, or agency that does
9494 not have an Internet website, making the records available for
9595 inspection and copying in a form regularly maintained by the
9696 shelter, municipality, or agency.
9797 SECTION 7. The changes in law made by this Act apply only to
9898 an animal placed at or disposed of by an animal shelter or releasing
9999 agency or counted in the shelter's or agency's animal total on or
100100 after the effective date of this Act.
101101 SECTION 8. This Act takes effect September 1, 2021.
