| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 186, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 186.008 to read as follows: |
|---|
| 12 | 12 | | Sec. 186.008. COMPREHENSIVE EMERGENCY OPERATIONS AND |
|---|
| 13 | 13 | | WEATHERIZATION PLAN. (a) In this section, "commission" means the |
|---|
| 14 | 14 | | Public Utility Commission of Texas. |
|---|
| 15 | 15 | | (b) Not later than January 1 of each year, the independent |
|---|
| 16 | 16 | | organization certified under Section 39.151 for the ERCOT power |
|---|
| 17 | 17 | | region shall prepare and deliver to the commission a comprehensive |
|---|
| 18 | 18 | | emergency operations and weatherization plan that includes: |
|---|
| 19 | 19 | | (1) emergency operations plans currently on file with |
|---|
| 20 | 20 | | the organization; |
|---|
| 21 | 21 | | (2) declarations of completion of weatherization |
|---|
| 22 | 22 | | preparations from all electric generation entities in the ERCOT |
|---|
| 23 | 23 | | power region; and |
|---|
| 24 | 24 | | (3) relevant seasonal assessments of resource |
|---|
| 25 | 25 | | adequacy, including projected resource capabilities, peak demand |
|---|
| 26 | 26 | | forecasts, and expected unit outage forecasts. |
|---|
| 27 | 27 | | (c) The commission shall analyze each emergency operations |
|---|
| 28 | 28 | | plan developed by the independent organization certified under |
|---|
| 29 | 29 | | Section 39.151 for the ERCOT power region and prepare a report on |
|---|
| 30 | 30 | | emergency operations and weatherization preparedness in this state |
|---|
| 31 | 31 | | that includes recommendations for improving the emergency |
|---|
| 32 | 32 | | operations plan, if any. |
|---|
| 33 | 33 | | (d) The commission shall submit the report described by |
|---|
| 34 | 34 | | Subsection (c) to the lieutenant governor, the speaker of the house |
|---|
| 35 | 35 | | of representatives, and the members of the legislature not later |
|---|
| 36 | 36 | | than September 1 of each year. |
|---|
| 37 | 37 | | (e) Emergency operations plans described by Subsection |
|---|
| 38 | 38 | | (b)(1) are public information except for the portions of the plans |
|---|
| 39 | 39 | | considered confidential under Chapter 552, Government Code, or |
|---|
| 40 | 40 | | other state or federal law. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2021. |
