66 AN ACT
77 relating to emergency operations and weatherization plans prepared
88 by the Electric Reliability Council of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 186, Utilities Code, is
1111 amended by adding Section 186.008 to read as follows:
1212 Sec. 186.008. COMPREHENSIVE EMERGENCY OPERATIONS AND
1313 WEATHERIZATION PLAN. (a) In this section, "commission" means the
1414 Public Utility Commission of Texas.
1515 (b) Not later than January 1 of each year, the independent
1616 organization certified under Section 39.151 for the ERCOT power
1717 region shall prepare and deliver to the commission a comprehensive
1818 emergency operations and weatherization plan that includes:
1919 (1) emergency operations plans currently on file with
2020 the organization;
2121 (2) declarations of completion of weatherization
2222 preparations from all electric generation entities in the ERCOT
2323 power region; and
2424 (3) relevant seasonal assessments of resource
2525 adequacy, including projected resource capabilities, peak demand
2626 forecasts, and expected unit outage forecasts.
2727 (c) The commission shall analyze each emergency operations
2828 plan developed by the independent organization certified under
2929 Section 39.151 for the ERCOT power region and prepare a report on
3030 emergency operations and weatherization preparedness in this state
3131 that includes recommendations for improving the emergency
3232 operations plan, if any.
3333 (d) The commission shall submit the report described by
3434 Subsection (c) to the lieutenant governor, the speaker of the house
3535 of representatives, and the members of the legislature not later
3636 than September 1 of each year.
3737 (e) Emergency operations plans described by Subsection
3838 (b)(1) are public information except for the portions of the plans
3939 considered confidential under Chapter 552, Government Code, or
4040 other state or federal law.
4141 SECTION 2. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2021.
