| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Subchapter C, Chapter 201, Transportation Code, |
|---|
| 9 | 15 | | is amended by adding Section 201.1056 to read as follows: |
|---|
| 10 | 16 | | Sec. 201.1056. AGREEMENTS FOR SERVICES ON FEDERAL MILITARY |
|---|
| 11 | 17 | | PROPERTY. (a) The department may enter into an agreement with the |
|---|
| 12 | 18 | | United States Department of Defense or another federal entity to |
|---|
| 13 | 19 | | allow the department to assist with the provision of road |
|---|
| 14 | 20 | | maintenance, improvement, relocation, or extension services for |
|---|
| 15 | 21 | | military installations. |
|---|
| 16 | 22 | | (b) State funds may not be used to provide services under an |
|---|
| 17 | 23 | | agreement entered into under this section. |
|---|
| 18 | 24 | | (c) Notwithstanding Subsection (a), the department may not |
|---|
| 19 | 25 | | enter into an agreement under this section if payment for the |
|---|
| 20 | 26 | | services provided under the agreement would be made from funds |
|---|
| 21 | 27 | | provided to the state for public roads under Title 23, United States |
|---|
| 22 | 28 | | Code. |
|---|
| 23 | 29 | | SECTION 2. This Act takes effect September 1, 2021. |
