410 AN ACT
511 relating to the authority of the Texas Department of Transportation
612 to provide road services on federal military property.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter C, Chapter 201, Transportation Code,
915 is amended by adding Section 201.1056 to read as follows:
1016 Sec. 201.1056. AGREEMENTS FOR SERVICES ON FEDERAL MILITARY
1117 PROPERTY. (a) The department may enter into an agreement with the
1218 United States Department of Defense or another federal entity to
1319 allow the department to assist with the provision of road
1420 maintenance, improvement, relocation, or extension services for
1521 military installations.
1622 (b) State funds may not be used to provide services under an
1723 agreement entered into under this section.
1824 (c) Notwithstanding Subsection (a), the department may not
1925 enter into an agreement under this section if payment for the
2026 services provided under the agreement would be made from funds
2127 provided to the state for public roads under Title 23, United States
2228 Code.
2329 SECTION 2. This Act takes effect September 1, 2021.
