| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 32.024, Human Resources Code, is amended | |
| 11 | 11 | by adding Subsection (rr) to read as follows: | |
| 12 | 12 | (rr) A children's hospital that meets Medicare | |
| 13 | 13 | participation requirements may enroll as a provider and receive | |
| 14 | 14 | reimbursement under the medical assistance program regardless of | |
| 15 | 15 | whether the hospital participates in the Medicare program. The | |
| 16 | 16 | executive commissioner shall adopt rules necessary to implement | |
| 17 | 17 | this subsection, including rules governing the application and | |
| 18 | 18 | enrollment process for a children's hospital seeking to participate | |
| 19 | 19 | in the medical assistance program as a Medicaid-only hospital under | |
| 20 | 20 | this subsection. | |
| 21 | 21 | SECTION 2. If before implementing any provision of this Act | |
| 22 | 22 | a state agency determines that a waiver or authorization from a | |
| 23 | 23 | federal agency is necessary for implementation of that provision, | |
| 24 | 24 | the agency affected by the provision shall request the waiver or | |
| 25 | 25 | authorization and may delay implementing that provision until the | |
| 26 | 26 | waiver or authorization is granted. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2021. |
