55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to coverage for supplemental ultrasound imaging to screen
88 for breast cancer under certain health benefit plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 1356, Insurance Code, is
1111 amended to read as follows:
1212 CHAPTER 1356. MAMMOGRAPHY AND OTHER BREAST IMAGING
1313 SECTION 2. Chapter 1356, Insurance Code, is amended by
1414 adding Section 1356.006 to read as follows:
1515 Sec. 1356.006. SUPPLEMENTAL COVERAGE REQUIRED. (a) An
1616 issuer of a health benefit plan that provides coverage under
1717 Section 1356.005 must provide coverage for supplemental two- or
1818 three-dimensional breast ultrasound imaging as part of an annual
1919 screening covered under the plan if a licensed health care
2020 professional treating the enrollee or screening the enrollee for
2121 breast cancer finds that the enrollee has dense breast tissue, as
2222 defined by the Breast Imaging Reporting and Database System (Fifth
2323 Edition) established by the American College of Radiology.
2424 (b) Coverage required by this section:
2525 (1) may not be less favorable than coverage for other
2626 radiological examinations under the plan; and
2727 (2) must be subject to the same dollar limits,
2828 deductibles, and coinsurance factors as coverage for other
2929 radiological examinations under the plan.
3030 SECTION 3. If before implementing any provision of this Act
3131 a state agency determines that a waiver or authorization from a
3232 federal agency is necessary for implementation of that provision,
3333 the agency affected by the provision shall request the waiver or
3434 authorization and may delay implementing that provision until the
3535 waiver or authorization is granted.
3636 SECTION 4. This Act applies only to a health benefit plan
3737 that is delivered, issued for delivery, or renewed on or after
3838 January 1, 2022. A health benefit plan that is delivered, issued
3939 for delivery, or renewed before January 1, 2022, is governed by the
4040 law as it existed immediately before the effective date of this Act,
4141 and that law is continued in effect for that purpose.
4242 SECTION 5. This Act takes effect September 1, 2021.
