55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the time frame for passing certain licensing
88 examinations for applicants seeking a license to practice medicine.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 155.051(b), Occupations Code, is amended
1111 to read as follows:
1212 (b) An applicant who is a graduate of a program designed to
1313 lead to both a doctor of philosophy degree and a doctor of medicine
1414 degree or doctor of osteopathy degree must pass each part of an
1515 examination described by Section 155.0511(2), (3), (4), (6), or (7)
1616 not later than the earlier of the second anniversary of the date the
1717 applicant completed all [the] graduate medical training undertaken
1818 by the applicant, including internship, residency, and fellowship,
1919 or the 12th anniversary of the date the applicant began the
2020 graduate medical training [described by Section 155.003(a)(5)].
2121 SECTION 2. As soon as practicable after the effective date
2222 of this Act, the Texas Medical Board shall adopt rules necessary to
2323 implement Section 155.051, Occupations Code, as amended by this
2424 Act.
2525 SECTION 3. Section 155.051, Occupations Code, as amended by
2626 this Act, applies to an application for a license to practice
2727 medicine issued under Chapter 155, Occupations Code, regardless of
2828 whether the application is submitted before, on, or after the
2929 effective date of this Act.
3030 SECTION 4. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2021.
