55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the duties and powers of peace officers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 2.13(b), Code of Criminal Procedure, is
1010 amended to read as follows:
1111 (b) The officer [shall]:
1212 (1) may, if authorized, [in every case authorized by
1313 the provisions of this Code,] interfere without warrant to prevent
1414 or suppress crime;
1515 (2) shall execute all lawful process issued to the
1616 officer by any magistrate or court;
1717 (3) shall give notice to some magistrate of all
1818 offenses committed within the officer's jurisdiction, if [where]
1919 the officer has probable cause [good reason] to believe there has
2020 been a violation of the penal law; and
2121 (4) may, if authorized, arrest offenders without
2222 warrant so [in every case where the officer is authorized by law, in
2323 order] that they may be taken before the proper magistrate or court
2424 and be tried.
2525 SECTION 2. Articles 2.14 and 2.15, Code of Criminal
2626 Procedure, are repealed.
2727 SECTION 3. This Act takes effect September 1, 2021.
