4	10		AN ACT
5	11		relating to inclusion of funds received by certain educational
6	12		institutions or programs in foundation school program funds for
7	13		purposes of certain budget reductions.
8	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	15		SECTION 1. Section 19.007, Education Code, is amended by
10	16		adding Subsection (h) to read as follows:
11	17		(h) Notwithstanding any other law, for purposes of any
12	18		budget reductions requested by the Legislative Budget Board or the
13	19		governor, any money received by the district or appropriated to the
14	20		department for purposes of operating the district is considered to
15	21		be part of the foundation school program and is not subject to those
16	22		budget reductions.
17	23		SECTION 2. Section 29.259, Education Code, is amended by
18	24		adding Subsection (j-1) to read as follows:
19	25		(j-1) Notwithstanding any other law, for purposes of any
20	26		budget reductions requested by the Legislative Budget Board or the
21	27		governor, any money received by a nonprofit entity granted a
22	28		charter under this section or appropriated to the agency for
23	29		purposes of operating an adult education program under this section
24	30		is considered to be part of the foundation school program and is not
25	31		subject to those budget reductions.
26	32		SECTION 3. Section 30.025, Education Code, is amended to
27	33		read as follows:
28	34		Sec. 30.025. FUNDING OF TEXAS SCHOOL FOR THE BLIND AND
29	35		VISUALLY IMPAIRED. (a) The funding of the Texas School for the Blind
30	36		and Visually Impaired consists of:
31	37		(1) money the legislature specifically appropriates
32	38		to the school;
33	39		(2) money the agency allocates to the school under
34	40		this code;
35	41		(3) money paid under a contract or other agreement;
36	42		(4) money the school receives through a gift or
37	43		bequest;
38	44		(5) a payment the school receives from a school
39	45		district under Section 30.003; and
40	46		(6) the school's share of the available school fund and
41	47		payments to compensate for payments no longer made from the
42	48		available school fund as provided by Section 30.003(f).
43	49		(b) Notwithstanding any other law, for purposes of any
44	50		budget reductions requested by the Legislative Budget Board or the
45	51		governor, any money received by the Texas School for the Blind and
46	52		Visually Impaired or appropriated to the agency for purposes of
47	53		operating the school is considered to be part of the foundation
48	54		school program and is not subject to those budget reductions.
49	55		SECTION 4. Section 30.056, Education Code, is amended to
50	56		read as follows:
51	57		Sec. 30.056. FUNDING OF THE TEXAS SCHOOL FOR THE DEAF. (a)
52	58		The funding of the Texas School for the Deaf consists of:
53	59		(1) money the legislature specifically appropriates
54	60		for the school;
55	61		(2) money the agency allocates to the school under
56	62		this code;
57	63		(3) money paid under a contract or other agreement;
58	64		(4) money the school receives through a gift or
59	65		bequest;
60	66		(5) a payment the school receives from a school
61	67		district under Section 30.003; and
62	68		(6) the school's share of the available school fund and
63	69		payments to compensate for payments no longer made from the
64	70		available school fund as provided by Section 30.003(f).
65	71		(b) Notwithstanding any other law, for purposes of any
66	72		budget reductions requested by the Legislative Budget Board or the
67	73		governor, any money received by the Texas School for the Deaf or
68	74		appropriated to the agency for purposes of operating the school is
69	75		considered to be part of the foundation school program and is not
70	76		subject to those budget reductions.
71	77		SECTION 5. Section 37.012, Education Code, is amended by
72	78		adding Subsection (f) to read as follows:
73	79		(f) Notwithstanding any other law, for purposes of any
74	80		budget reductions requested by the Legislative Budget Board or the
75	81		governor, any money received by a local juvenile probation
76	82		department or appropriated to the Texas Juvenile Justice Department
77	83		for purposes of operating a juvenile justice alternative education
78	84		program is considered to be part of the foundation school program
79	85		and is not subject to those budget reductions.
80	86		SECTION 6. This Act takes effect immediately if it receives
81	87		a vote of two-thirds of all the members elected to each house, as
82	88		provided by Section 39, Article III, Texas Constitution. If this
83	89		Act does not receive the vote necessary for immediate effect, this
84	90		Act takes effect September 1, 2021.
