410 AN ACT
511 relating to inclusion of funds received by certain educational
612 institutions or programs in foundation school program funds for
713 purposes of certain budget reductions.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 19.007, Education Code, is amended by
1016 adding Subsection (h) to read as follows:
1117 (h) Notwithstanding any other law, for purposes of any
1218 budget reductions requested by the Legislative Budget Board or the
1319 governor, any money received by the district or appropriated to the
1420 department for purposes of operating the district is considered to
1521 be part of the foundation school program and is not subject to those
1622 budget reductions.
1723 SECTION 2. Section 29.259, Education Code, is amended by
1824 adding Subsection (j-1) to read as follows:
1925 (j-1) Notwithstanding any other law, for purposes of any
2026 budget reductions requested by the Legislative Budget Board or the
2127 governor, any money received by a nonprofit entity granted a
2228 charter under this section or appropriated to the agency for
2329 purposes of operating an adult education program under this section
2430 is considered to be part of the foundation school program and is not
2531 subject to those budget reductions.
2632 SECTION 3. Section 30.025, Education Code, is amended to
2733 read as follows:
2834 Sec. 30.025. FUNDING OF TEXAS SCHOOL FOR THE BLIND AND
2935 VISUALLY IMPAIRED. (a) The funding of the Texas School for the Blind
3036 and Visually Impaired consists of:
3137 (1) money the legislature specifically appropriates
3238 to the school;
3339 (2) money the agency allocates to the school under
3440 this code;
3541 (3) money paid under a contract or other agreement;
3642 (4) money the school receives through a gift or
3743 bequest;
3844 (5) a payment the school receives from a school
3945 district under Section 30.003; and
4046 (6) the school's share of the available school fund and
4147 payments to compensate for payments no longer made from the
4248 available school fund as provided by Section 30.003(f).
4349 (b) Notwithstanding any other law, for purposes of any
4450 budget reductions requested by the Legislative Budget Board or the
4551 governor, any money received by the Texas School for the Blind and
4652 Visually Impaired or appropriated to the agency for purposes of
4753 operating the school is considered to be part of the foundation
4854 school program and is not subject to those budget reductions.
4955 SECTION 4. Section 30.056, Education Code, is amended to
5056 read as follows:
5157 Sec. 30.056. FUNDING OF THE TEXAS SCHOOL FOR THE DEAF. (a)
5258 The funding of the Texas School for the Deaf consists of:
5359 (1) money the legislature specifically appropriates
5460 for the school;
5561 (2) money the agency allocates to the school under
5662 this code;
5763 (3) money paid under a contract or other agreement;
5864 (4) money the school receives through a gift or
5965 bequest;
6066 (5) a payment the school receives from a school
6167 district under Section 30.003; and
6268 (6) the school's share of the available school fund and
6369 payments to compensate for payments no longer made from the
6470 available school fund as provided by Section 30.003(f).
6571 (b) Notwithstanding any other law, for purposes of any
6672 budget reductions requested by the Legislative Budget Board or the
6773 governor, any money received by the Texas School for the Deaf or
6874 appropriated to the agency for purposes of operating the school is
6975 considered to be part of the foundation school program and is not
7076 subject to those budget reductions.
7177 SECTION 5. Section 37.012, Education Code, is amended by
7278 adding Subsection (f) to read as follows:
7379 (f) Notwithstanding any other law, for purposes of any
7480 budget reductions requested by the Legislative Budget Board or the
7581 governor, any money received by a local juvenile probation
7682 department or appropriated to the Texas Juvenile Justice Department
7783 for purposes of operating a juvenile justice alternative education
7884 program is considered to be part of the foundation school program
7985 and is not subject to those budget reductions.
8086 SECTION 6. This Act takes effect immediately if it receives
8187 a vote of two-thirds of all the members elected to each house, as
8288 provided by Section 39, Article III, Texas Constitution. If this
8389 Act does not receive the vote necessary for immediate effect, this
8490 Act takes effect September 1, 2021.
