10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 303.042, Local Government Code, is | |
12 | 12 | amended by adding Subsection (d-1) to read as follows: | |
13 | 13 | (d-1) An exemption under this section for a multifamily | |
14 | 14 | residential development which is owned by a public facility | |
15 | 15 | corporation applies only if the operator of the development does | |
16 | 16 | not base any refusal to rent a unit to an individual or family on the | |
17 | 17 | individual's or family's participation in the federal Section 8 | |
18 | 18 | Housing Choice Voucher Program. | |
19 | 19 | SECTION 2. The change in law made by this Act applies only | |
20 | 20 | to a multifamily residential development that is constructed or | |
21 | 21 | acquired by a public facility corporation on or after the effective | |
22 | 22 | date of this Act. A multifamily residential development that is | |
23 | 23 | constructed or acquired by a public facility corporation before the | |
24 | 24 | effective date of this Act is governed by the law in effect on the | |
25 | 25 | date the development was constructed or acquired, and the former | |
26 | 26 | law is continued in effect for that purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2021. |
