66 AN ACT
77 relating to requirements for beneficial tax treatment related to a
88 leasehold or other possessory interest in a public facility used to
99 provide affordable housing.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 303.042, Local Government Code, is
1212 amended by adding Subsection (d-1) to read as follows:
1313 (d-1) An exemption under this section for a multifamily
1414 residential development which is owned by a public facility
1515 corporation applies only if the operator of the development does
1616 not base any refusal to rent a unit to an individual or family on the
1717 individual's or family's participation in the federal Section 8
1818 Housing Choice Voucher Program.
1919 SECTION 2. The change in law made by this Act applies only
2020 to a multifamily residential development that is constructed or
2121 acquired by a public facility corporation on or after the effective
2222 date of this Act. A multifamily residential development that is
2323 constructed or acquired by a public facility corporation before the
2424 effective date of this Act is governed by the law in effect on the
2525 date the development was constructed or acquired, and the former
2626 law is continued in effect for that purpose.
2727 SECTION 3. This Act takes effect September 1, 2021.
