55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the offenses of reckless driving and
88 racing on a highway and to the forfeiture of contraband relating to
99 that conduct; increasing a criminal penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. This Act shall be known as Olivia's Law.
1212 SECTION 2. (a) Article 59.01(2), Code of Criminal
1313 Procedure, as effective until January 1, 2022, is amended to read as
1414 follows:
1515 (2) "Contraband" means property of any nature,
1616 including real, personal, tangible, or intangible, that is:
1717 (A) used in the commission of:
1818 (i) any first or second degree felony under
1919 the Penal Code;
2020 (ii) any felony under Section 15.031(b),
2121 21.11, or 38.04 or Chapter 29, 30, 31, 32, 33, 33A, or 35, Penal
2222 Code;
2323 (iii) any felony under Chapter 43, Penal
2424 Code, except as provided by Paragraph (B);
2525 (iv) any felony under The Securities Act
2626 (Article 581-1 et seq., Vernon's Texas Civil Statutes); or
2727 (v) any offense under Chapter 49, Penal
2828 Code, that is punishable as a felony of the third degree or state
2929 jail felony, if the defendant has been previously convicted three
3030 times of an offense under that chapter;
3131 (B) used or intended to be used in the commission
3232 of:
3333 (i) any felony under Chapter 481, Health
3434 and Safety Code (Texas Controlled Substances Act);
3535 (ii) any felony under Chapter 483, Health
3636 and Safety Code;
3737 (iii) a felony under Chapter 151, Finance
3838 Code;
3939 (iv) any felony under Chapter 20A or 34,
4040 Penal Code;
4141 (v) a Class A misdemeanor under Subchapter
4242 B, Chapter 365, Health and Safety Code, if the defendant has been
4343 previously convicted twice of an offense under that subchapter;
4444 (vi) any felony under Chapter 32, Human
4545 Resources Code, or Chapter 31, 32, 35A, or 37, Penal Code, that
4646 involves a health care program, as defined by Section 35A.01, Penal
4747 Code;
4848 (vii) a Class B misdemeanor under Chapter
4949 522, Business & Commerce Code;
5050 (viii) a Class A misdemeanor under Section
5151 306.051, Business & Commerce Code;
5252 (ix) any offense under Section 42.10, Penal
5353 Code;
5454 (x) any offense under Section 46.06(a)(1)
5555 or 46.14, Penal Code;
5656 (xi) any offense under Chapter 71, Penal
5757 Code;
5858 (xii) any offense under Section 20.05,
5959 20.06, 20.07, 43.04, or 43.05, Penal Code; [or]
6060 (xiii) an offense under Section 326.002,
6161 Business & Commerce Code; or
6262 (xiv) a Class A misdemeanor or any felony
6363 under Section 545.401 or 545.420, Transportation Code, if the
6464 defendant has been previously convicted three or more times of an
6565 offense under either section;
6666 (C) the proceeds gained from the commission of a
6767 felony listed in Paragraph (A) or (B) of this subdivision, a
6868 misdemeanor listed in Paragraph (B)(vii), (ix), (x), (xi), or (xii)
6969 of this subdivision, or a crime of violence;
7070 (D) acquired with proceeds gained from the
7171 commission of a felony listed in Paragraph (A) or (B) of this
7272 subdivision, a misdemeanor listed in Paragraph (B)(vii), (ix), (x),
7373 (xi), or (xii) of this subdivision, or a crime of violence;
7474 (E) used to facilitate or intended to be used to
7575 facilitate the commission of a felony under Section 15.031 or
7676 Chapter 43, Penal Code; or
7777 (F) used to facilitate or intended to be used to
7878 facilitate the commission of an offense under Section 20.05, 20.06,
7979 or 20.07 or Chapter 20A, Penal Code.
8080 (b) Article 59.01(2), Code of Criminal Procedure, as
8181 effective January 1, 2022, is amended to read as follows:
8282 (2) "Contraband" means property of any nature,
8383 including real, personal, tangible, or intangible, that is:
8484 (A) used in the commission of:
8585 (i) any first or second degree felony under
8686 the Penal Code;
8787 (ii) any felony under Section 15.031(b),
8888 21.11, or 38.04 or Chapter 29, 30, 31, 32, 33, 33A, or 35, Penal
8989 Code;
9090 (iii) any felony under Chapter 43, Penal
9191 Code, except as provided by Paragraph (B);
9292 (iv) any felony under The Securities Act

9494 (v) any offense under Chapter 49, Penal
9595 Code, that is punishable as a felony of the third degree or state
9696 jail felony, if the defendant has been previously convicted three
9797 times of an offense under that chapter;
9898 (B) used or intended to be used in the commission
9999 of:
100100 (i) any felony under Chapter 481, Health
101101 and Safety Code (Texas Controlled Substances Act);
102102 (ii) any felony under Chapter 483, Health
103103 and Safety Code;
104104 (iii) a felony under Chapter 151, Finance
105105 Code;
106106 (iv) any felony under Chapter 20A or 34,
107107 Penal Code;
108108 (v) a Class A misdemeanor under Subchapter
109109 B, Chapter 365, Health and Safety Code, if the defendant has been
110110 previously convicted twice of an offense under that subchapter;
111111 (vi) any felony under Chapter 32, Human
112112 Resources Code, or Chapter 31, 32, 35A, or 37, Penal Code, that
113113 involves a health care program, as defined by Section 35A.01, Penal
114114 Code;
115115 (vii) a Class B misdemeanor under Chapter
116116 522, Business & Commerce Code;
117117 (viii) a Class A misdemeanor under Section
118118 306.051, Business & Commerce Code;
119119 (ix) any offense under Section 42.10, Penal
120120 Code;
121121 (x) any offense under Section 46.06(a)(1)
122122 or 46.14, Penal Code;
123123 (xi) any offense under Chapter 71, Penal
124124 Code;
125125 (xii) any offense under Section 20.05,
126126 20.06, 20.07, 43.04, or 43.05, Penal Code; [or]
127127 (xiii) an offense under Section 326.002,
128128 Business & Commerce Code; or
129129 (xiv) a Class A misdemeanor or any felony
130130 under Section 545.401 or 545.420, Transportation Code, if the
131131 defendant has been previously convicted three or more times of an
132132 offense under either section;
133133 (C) the proceeds gained from the commission of a
134134 felony listed in Paragraph (A) or (B) of this subdivision, a
135135 misdemeanor listed in Paragraph (B)(vii), (ix), (x), (xi), or (xii)
136136 of this subdivision, or a crime of violence;
137137 (D) acquired with proceeds gained from the
138138 commission of a felony listed in Paragraph (A) or (B) of this
139139 subdivision, a misdemeanor listed in Paragraph (B)(vii), (ix), (x),
140140 (xi), or (xii) of this subdivision, or a crime of violence;
141141 (E) used to facilitate or intended to be used to
142142 facilitate the commission of a felony under Section 15.031 or
143143 Chapter 43, Penal Code; or
144144 (F) used to facilitate or intended to be used to
145145 facilitate the commission of an offense under Section 20.05, 20.06,
146146 or 20.07 or Chapter 20A, Penal Code.
147147 SECTION 3. Section 545.401, Transportation Code, is amended
148148 by adding Subsection (a-1) and amending Subsection (b) to read as
149149 follows:
150150 (a-1) There is a rebuttable presumption that the registered
151151 owner of the motor vehicle is the person operating the vehicle at
152152 the time an offense under this section occurred.
153153 (b) An offense under this section is a Class B misdemeanor,
154154 except that the offense is a Class A misdemeanor if the person has
155155 been previously convicted under this section [punishable by:
156156 [(1) a fine not to exceed $200;
157157 [(2) confinement in county jail for not more than 30
158158 days; or
159159 [(3) both the fine and the confinement].
160160 SECTION 4. Section 545.420, Transportation Code, is amended
161161 by adding Subsection (c) to read as follows:
162162 (c) There is a rebuttable presumption that the registered
163163 owner of the motor vehicle is the person operating the vehicle at
164164 the time an offense under this section occurred.
165165 SECTION 5. Subchapter C, Chapter 1001, Education Code, is
166166 amended by adding Section 1001.113 to read as follows:
167167 Sec. 1001.113. INFORMATION RELATING TO STREET RACING. The
168168 commission by rule shall require that information relating to the
169169 dangers and consequences of street racing in violation of Section
170170 545.420, Transportation Code, be included in the curriculum of each
171171 driver education and driving safety course.
172172 SECTION 6. (a) Not later than March 1, 2022, the Texas
173173 Commission of Licensing and Regulation shall adopt the rules
174174 required by Section 1001.113, Education Code, as added by this Act.
175175 (b) Not later than September 1, 2022, each provider of a
176176 driver education course or driving safety course shall submit the
177177 curriculum adopted pursuant to Section 1001.113, Education Code, as
178178 added by this Act, to the Texas Commission of Licensing and
179179 Regulation for approval.
180180 SECTION 7. The changes in law made by this Act apply only to
181181 an offense committed on or after the effective date of this Act. An
182182 offense committed before the effective date of this Act is governed
183183 by the law in effect on the date the offense was committed, and the
184184 former law is continued in effect for that purpose. For purposes of
185185 this section, an offense was committed before the effective date of
186186 this Act if any element of the offense occurred before that date.
187187 SECTION 8. This Act takes effect September 1, 2021.
