44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a requirement to make certain environmental and water
77 use permit applications available online.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 5.552, Water Code, is amended by
1010 amending Subsection (b) and adding Subsection (b-1) to read as
1111 follows:
1212 (b) Not later than the 30th day after the date the executive
1313 director determines the application to be administratively
1414 complete:
1515 (1) the applicant shall:
1616 (A) post a copy of the application on a publicly
1717 accessible Internet website and provide to the commission the
1818 address of that website; and
1919 (B) publish, [notice of intent to obtain a
2020 permit] at least once in the newspaper of largest circulation in the
2121 county in which the facility to which the application relates is
2222 located or proposed to be located or, if the facility to which the
2323 application relates is located or proposed to be located in a
2424 municipality, at least once in a newspaper of general circulation
2525 in the municipality, a notice of intent to obtain a permit that
2626 includes the Internet website address provided under Paragraph (A);
2727 and
2828 (2) the chief clerk of the commission shall mail
2929 notice of intent to obtain a permit to:
3030 (A) the state senator and representative who
3131 represent the general area in which the facility is located or
3232 proposed to be located;
3333 (B) the mayor and health authorities of the
3434 municipality in which the facility is located or proposed to be
3535 located;
3636 (C) the county judge and health authorities of
3737 the county in which the facility is located or proposed to be
3838 located; and
3939 (D) the river authority in which the facility is
4040 located or proposed to be located if the application is under
4141 Chapter 26[, Water Code].
4242 (b-1) The applicant shall:
4343 (1) post at the Internet website address described by
4444 Subsection (b)(1) any subsequent revision or supplement to the
4545 application as the revision or supplement becomes available; and
4646 (2) maintain the posting at the Internet website
4747 address described by Subsection (b)(1) until the commission takes
4848 final action on the application.
4949 SECTION 2. Section 11.124, Water Code, is amended by adding
5050 Subsection (g) to read as follows:
5151 (g) The applicant shall post a copy of the application, map,
5252 and any supporting materials required by this subchapter on a
5353 publicly accessible Internet website and provide the commission
5454 with the address of that website in the application sent to the
5555 commission under this section. The applicant shall:
5656 (1) post any subsequent revision or supplement to the
5757 application as the revision or supplement becomes available; and
5858 (2) maintain the posting until the commission takes
5959 final action on the application.
6060 SECTION 3. Section 11.132(c), Water Code, is amended to
6161 read as follows:
6262 (c) In the notice, the commission shall:
6363 (1) state the name and address of the applicant;
6464 (2) state the date the application was filed;
6565 (3) state the purpose and extent of the proposed
6666 appropriation of water;
6767 (4) identify the source of supply and the place where
6868 the water is to be stored or taken or diverted from the source of
6969 supply;
7070 (5) identify any proposed alternative source of water,
7171 other than state water, identified by the applicant;
7272 (6) specify the time and location where the commission
7373 will consider the application;
7474 (7) provide the Internet website address of the posted
7575 application, map, and supporting materials; and
7676 (8) [(7)] give any additional information the
7777 commission considers necessary.
7878 SECTION 4. The changes in law made by this Act apply only to
7979 an application received by the Texas Commission on Environmental
8080 Quality on or after the effective date of this Act. An application
8181 received before the effective date of this Act is governed by the
8282 law in effect on the date the application was received, and the
8383 former law is continued in effect for that purpose.
8484 SECTION 5. This Act takes effect September 1, 2021.
