66 AN ACT
77 relating to an agreement with a private entity for dynamic message
88 signs used in certain statewide alert systems.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) This section takes effect only if the Act of
1111 the 87th Legislature, Regular Session, 2021, relating to
1212 nonsubstantive additions to and corrections in enacted codes
1313 becomes law.
1414 (b) Chapter 411, Government Code, is amended by adding
1515 Subchapter K-1 to read as follows:
1616 SUBCHAPTER K-1. DYNAMIC MESSAGE SIGNS FOR ALERT SYSTEMS
1717 Sec. 411.301. DYNAMIC MESSAGE SIGNS. (a) Except as
1818 provided by Subsection (c), the Texas Department of Transportation
1919 shall enter into an agreement with a private entity to provide
2020 information necessary for statewide alert systems created under
2121 Subchapters L, M, P, P-1, and Q as added by Chapter 227 (H.B. 1769),
2222 Acts of the 86th Legislature, Regular Session, 2019, through a
2323 system of dynamic message signs that are:
2424 (1) located across the state; and
2525 (2) capable of displaying digital images useful in
2626 locating the missing individual.
2727 (b) The agreement under Subsection (a) must generate net
2828 revenue to the state, and tax revenue may not be used to fund the
2929 installation and operation of the dynamic message signs described
3030 by Subsection (a). The Texas Department of Transportation may
3131 accept gifts and grants of money, equipment, or other resources
3232 necessary to install and operate the dynamic message signs
3333 described by Subsection (a).
3434 (c) The Texas Department of Transportation is not required
3535 to enter into an agreement under Subsection (a) if the department
3636 receives notice from the United States Department of Transportation
3737 Federal Highway Administration that the use of the dynamic message
3838 signs described by that subsection would result in the loss of
3939 federal highway funding or other punitive actions taken against
4040 this state due to noncompliance with federal laws, regulations, or
4141 policies.
4242 SECTION 2. (a) This section takes effect only if the Act of
4343 the 87th Legislature, Regular Session, 2021, relating to
4444 nonsubstantive additions to and corrections in enacted codes does
4545 not become law.
4646 (b) Chapter 411, Government Code, is amended by adding
4747 Subchapter K-1 to read as follows:
4848 SUBCHAPTER K-1. DYNAMIC MESSAGE SIGNS FOR ALERT SYSTEMS
4949 Sec. 411.301. DYNAMIC MESSAGE SIGNS. (a) Except as
5050 provided by Subsection (c), the Texas Department of Transportation
5151 shall enter into an agreement with a private entity to provide
5252 information necessary for statewide alert systems created under
5353 Subchapters L, M, P, Q as added by Chapter 220 (H.B. 833), Acts of
5454 the 86th Legislature, Regular Session, 2019, and Q as added by
5555 Chapter 227 (H.B. 1769), Acts of the 86th Legislature, Regular
5656 Session, 2019, through a system of dynamic message signs that are:
5757 (1) located across the state; and
5858 (2) capable of displaying digital images useful in
5959 locating the missing individual.
6060 (b) The agreement under Subsection (a) must generate net
6161 revenue to the state, and tax revenue may not be used to fund the
6262 installation and operation of the dynamic message signs described
6363 by Subsection (a). The Texas Department of Transportation may
6464 accept gifts and grants of money, equipment, or other resources
6565 necessary to install and operate the dynamic message signs
6666 described by Subsection (a).
6767 (c) The Texas Department of Transportation is not required
6868 to enter into an agreement under Subsection (a) if the department
