55 AN ACT
66 relating to identification requirements for early voting by mail.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 84.001(c), Election Code, is amended to
99 read as follows:
1010 (c) An applicant must [is not required to] use an official
1111 application form described by Section 84.011.
1212 SECTION 2. Section 84.002(a), Election Code, is amended to
1313 read as follows:
1414 (a) An early voting ballot application must include:
1515 (1) the applicant's name and the address at which the
1616 applicant is registered to vote;
1717 (1-a) the following information:
1818 (A) the number of the applicant's election
1919 identification certificate or unexpired driver's license or
2020 personal identification card issued by the Department of Public
2121 Safety;
2222 (B) the applicant's voter registration number;
2323 (C) the number of the applicant's unexpired
2424 United States passport; or
2525 (D) the applicant's social security number;
2626 (2) for an application for a ballot to be voted by mail
2727 on the ground of absence from the county of residence, the address
2828 outside the applicant's county of residence to which the ballot is
2929 to be mailed;
3030 (3) for an application for a ballot to be voted by mail
3131 on the ground of age or disability, the address of the hospital,
3232 nursing home or other long-term care facility, or retirement
3333 center, or of a person related to the applicant within the second
3434 degree by affinity or the third degree by consanguinity, as
3535 determined under Chapter 573, Government Code, if the applicant is
3636 living at that address and that address is different from the
3737 address at which the applicant is registered to vote;
3838 (4) for an application for a ballot to be voted by mail
3939 on the ground of confinement in jail, the address of the jail or of a
4040 person related to the applicant within the degree described by
4141 Subdivision (3);
4242 (5) for an application for a ballot to be voted by mail
4343 on any ground, an indication of each election for which the
4444 applicant is applying for a ballot; and
4545 (6) an indication of the ground of eligibility for
4646 early voting.
4747 SECTION 3. Section 84.011(a), Election Code, is amended to
4848 read as follows:
4949 (a) The officially prescribed application form for an early
5050 voting ballot must include:
5151 (1) immediately preceding the signature space the
5252 statement: "I certify that the information given in this
5353 application is true, and I understand that giving false information
5454 in this application is a crime.";
5555 (2) a statement informing the applicant of the
5656 offenses prescribed by Sections 84.003 and 84.004;
5757 (3) a space [spaces] for entering an applicant's
5858 [voter registration number and] county election precinct of
5959 registration, with a statement informing the applicant that failure
6060 to furnish that information does not invalidate the application;
6161 (3-a) a space for entering the information required
6262 under Section 84.002(a)(1-a); and
6363 (4) on an application for a ballot to be voted by mail:
6464 (A) a space for an applicant applying on the
6565 ground of absence from the county of residence to indicate the date
6666 on or after which the applicant can receive mail at the address
6767 outside the county;
6868 (B) a space for indicating the fact that an
6969 applicant whose application is signed by a witness cannot make the
7070 applicant's mark and a space for indicating the relationship or
7171 lack of relationship of the witness to the applicant;
7272 (C) a space for entering an applicant's telephone
7373 number, with a statement informing the applicant that failure to
7474 furnish that information does not invalidate the application;
7575 (D) a space or box for an applicant applying on
7676 the ground of age or disability to indicate that the address to
7777 which the ballot is to be mailed is the address of a facility or
7878 relative described by Section 84.002(a)(3), if applicable;
7979 (E) a space or box for an applicant applying on
8080 the ground of confinement in jail to indicate that the address to
8181 which the ballot is to be mailed is the address of a relative
8282 described by Section 84.002(a)(4), if applicable;
8383 (F) a space for an applicant applying on the
8484 ground of age or disability to indicate if the application is an
8585 application under Section 86.0015;
8686 (G) spaces for entering the signature, printed
8787 name, and residence address of any person assisting the applicant;
8888 (H) a statement informing the applicant of the
8989 condition prescribed by Section 81.005; and
9090 (I) a statement informing the applicant of the
9191 requirement prescribed by Section 86.003(c).
9292 SECTION 4. Section 86.001, Election Code, is amended by
9393 adding Subsection (f) to read as follows:
9494 (f) If the application does not include the information
9595 required under Section 84.002(a)(1-a), the clerk shall reject the
9696 application.
9797 SECTION 5. Section 86.002, Election Code, is amended by
9898 adding Subsections (g) and (h) to read as follows:
9999 (g) The ballot envelope must include a space for the voter
100100 to enter the following information:
101101 (1) the number of the voter's election identification
102102 certificate or unexpired driver's license or personal
103103 identification card issued by the Department of Public Safety;
104104 (2) the voter's voter registration number;
105105 (3) the number of the voter's unexpired United States
106106 passport; or
107107 (4) the voter's social security number.
108108 (h) No record associating an individual voter with a ballot
109109 may be created.
110110 SECTION 6. Section 87.041(b), Election Code, is amended to
111111 read as follows:
112112 (b) A ballot may be accepted only if:
113113 (1) the carrier envelope certificate is properly
114114 executed;
115115 (2) neither the voter's signature on the ballot
116116 application nor the signature on the carrier envelope certificate
117117 is determined to have been executed by a person other than the
118118 voter, unless signed by a witness;
119119 (3) the voter's ballot application states a legal
120120 ground for early voting by mail;
121121 (4) the voter is registered to vote, if registration
122122 is required by law;
123123 (5) the address to which the ballot was mailed to the
124124 voter, as indicated by the application, was outside the voter's
125125 county of residence, if the ground for early voting is absence from
126126 the county of residence;
127127 (6) for a voter to whom a statement of residence form
128128 was required to be sent under Section 86.002(a), the statement of
129129 residence is returned in the carrier envelope and indicates that
130130 the voter satisfies the residence requirements prescribed by
131131 Section 63.0011; [and]
132132 (7) the address to which the ballot was mailed to the
133133 voter is an address that is otherwise required by Sections 84.002
134134 and 86.003; and
135135 (8) the voter has provided the information required
136136 under Section 86.002(g).
137137 SECTION 7. The changes in law made by this Act apply only to
138138 an application to vote an early voting ballot by mail submitted on
139139 or after the effective date of this Act. An application to vote an
140140 early voting ballot by mail submitted before the effective date of
141141 this Act is governed by the law in effect when the application was
142142 submitted, and the former law is continued in effect for that
143143 purpose.
144144 SECTION 8. This Act takes effect September 1, 2021.
