| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 372, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 372.060 to read as follows: |
|---|
| 12 | 12 | | Sec. 372.060. CONSTRUCTION OF NONTOLLED FRONTAGE ROAD |
|---|
| 13 | 13 | | REQUIRED FOR CERTAIN TOLL PROJECTS. (a) Except as provided by |
|---|
| 14 | 14 | | Section 228.201, a toll project entity may not construct a toll |
|---|
| 15 | 15 | | project along the route of a previously nontolled highway unless |
|---|
| 16 | 16 | | the entity constructs at least one adjacent nontolled lane of |
|---|
| 17 | 17 | | frontage road for each direction of travel of the toll project. |
|---|
| 18 | 18 | | (b) The lanes of frontage road described by Subsection (a) |
|---|
| 19 | 19 | | shall be maintained by the entity that had authority over the |
|---|
| 20 | 20 | | previously nontolled highway along which the toll project is |
|---|
| 21 | 21 | | constructed. |

| 22 | 22 | | SECTION 2. Section 372.060, Transportation Code, as added |
|---|
| 23 | 23 | | by this Act, applies only to a toll project for which a contract for |
|---|
| 24 | 24 | | financing, construction, or operation is entered into on or after |
|---|
| 25 | 25 | | the effective date of this Act. A toll project for which a contract |
|---|
| 26 | 26 | | was entered into before the effective date of this Act is governed |
|---|
| 27 | 27 | | by the law as it existed at the time the contract was entered into, |
|---|
| 28 | 28 | | and the former law is continued in effect for that purpose. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2021. |
