9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 111, Occupations Code, is amended by | |
11 | 11 | adding Section 111.009 to read as follows: | |
12 | 12 | Sec. 111.009. HEALTH PROFESSIONAL LOCATED OUTSIDE OF STATE. | |
13 | 13 | (a) Notwithstanding any other law, a health professional located | |
14 | 14 | outside of this state who holds an active and unencumbered license | |
15 | 15 | issued by another state may provide to a patient located in this | |
16 | 16 | state a telehealth service if the health professional is authorized | |
17 | 17 | to provide the service by the state in which the health professional | |
18 | 18 | is licensed. | |
19 | 19 | (b) The standard of care for a health professional who | |
20 | 20 | provides a telehealth service to a patient under this section is the | |
21 | 21 | same as the standard of care for a health professional who provides | |
22 | 22 | an in-person health care service to a patient. | |
23 | 23 | (c) A practitioner-patient relationship may be established | |
24 | 24 | through a telehealth service provided under this section. | |
25 | 25 | (d) An agency with regulatory authority over a health | |
26 | 26 | professional shall adopt rules to implement this section. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2021. |
