55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorizing a court to require defendants confined in a
88 penal institution to appear by videoconference in criminal cases.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1, Code of Criminal Procedure, is
1111 amended by adding Article 1.028 to read as follows:
1212 Art. 1.028. PRESENCE BY VIDEOCONFERENCE. Notwithstanding
1313 any other provision of this code, a court may require a defendant
1414 without the defendant's consent to appear, for any proceeding
1515 related to the prosecution of a criminal offense, by
1616 videoconference in the manner described by Article 27.18 if the
1717 defendant is confined in a penal institution at the time of the
1818 proceeding.
1919 SECTION 2. The change in law made by this Act applies only
2020 to a criminal proceeding that commences on or after the effective
2121 date of this Act. A criminal proceeding that commenced before the
2222 effective date of this Act is governed by the law in effect on the
2323 date the proceeding commenced, and the former law is continued in
2424 effect for that purpose.
2525 SECTION 3. This Act takes effect September 1, 2021.
