9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 1, Code of Criminal Procedure, is | |
11 | 11 | amended by adding Article 1.028 to read as follows: | |
12 | 12 | Art. 1.028. PRESENCE BY VIDEOCONFERENCE. Notwithstanding | |
13 | 13 | any other provision of this code, a court may require a defendant | |
14 | 14 | without the defendant's consent to appear, for any proceeding | |
15 | 15 | related to the prosecution of a criminal offense, by | |
16 | 16 | videoconference in the manner described by Article 27.18 if the | |
17 | 17 | defendant is confined in a penal institution at the time of the | |
18 | 18 | proceeding. | |
19 | 19 | SECTION 2. The change in law made by this Act applies only | |
20 | 20 | to a criminal proceeding that commences on or after the effective | |
21 | 21 | date of this Act. A criminal proceeding that commenced before the | |
22 | 22 | effective date of this Act is governed by the law in effect on the | |
23 | 23 | date the proceeding commenced, and the former law is continued in | |
24 | 24 | effect for that purpose. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
