6	8		AN ACT
7	9		relating to the availability of dates of birth under the public
8	10		information law.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Subchapter B, Chapter 552, Government Code, is
11	13		amended by adding Section 552.0223 to read as follows:
12	14		Sec. 552.0223. DATES OF BIRTH. Notwithstanding Section
13	15		552.101, this chapter does not authorize a governmental body to
14	16		withhold a date of birth except as:
15	17		(1) permitted by Section 552.102;
16	18		(2) permitted by the federal privacy requirements
17	19		adopted under the Health Insurance Portability and Accountability
18	20		Act of 1996 (Pub. L. No. 104-191) contained in 45 C.F.R. Part 160
19	21		and 45 C.F.R. Part 164; or
20	22		(3) otherwise provided by constitutional or statutory
21	23		law.
22	24		SECTION 2. The changes in law made by this Act apply only to
23	25		a request for information that is received by a governmental body or
24	26		an officer for public information on or after the effective date of
25	27		this Act. A request for information that was received before the
26	28		effective date of this Act is governed by the law in effect on the
27	29		date the request was received, and the former law is continued in
28	30		effect for that purpose.
29	31		SECTION 3. This Act takes effect immediately if it receives
30	32		a vote of two-thirds of all the members elected to each house, as
31	33		provided by Section 39, Article III, Texas Constitution. If this
32	34		Act does not receive the vote necessary for immediate effect, this
33	35		Act takes effect September 1, 2021.
