55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of the Texas Enterprise Fund for a small
88 business loan guarantee program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 481.078, Government Code, is amended by
1111 adding Subsections (b-1) and (m) to read as follows:
1212 (b-1) A balance sufficient to pay the fund's obligations
1313 under loan guarantees made under Subsection (m) must be maintained
1414 in the fund.
1515 (m) The fund may be used to guarantee small business loans
1616 that have been determined by the United States Small Business
1717 Administration to meet the requirements of a loan eligible for a
1818 loan guarantee under the 7(a) loan program established under 15
1919 U.S.C. Section 636(a). A loan guaranteed by the fund under this
2020 subsection may not exceed $2 million. The structure of loan
2121 guarantees under this subsection must be modeled on the United
2222 States Small Business Administration's 7(a) loan program
2323 established under 15 U.S.C. Section 636(a).
2424 SECTION 2. Section 481.079(a), Government Code, is amended
2525 to read as follows:
2626 (a) Before the beginning of each regular session of the
2727 legislature, the governor shall submit to the lieutenant governor,
2828 the speaker of the house of representatives, and each other member
2929 of the legislature a report on grants or loan guarantees made under
3030 Section 481.078 that states:
3131 (1) with respect to grants awarded under the fund:
3232 (A) the number of direct jobs each recipient
3333 committed to create in this state;
3434 (B) [(2)] the number of direct jobs each
3535 recipient created in this state;
3636 (C) [(3)] the median wage of the jobs each
3737 recipient created in this state;
3838 (D) [(4)] the amount of capital investment each
3939 recipient committed to expend or allocate per project in this
4040 state;
4141 (E) [(5)] the amount of capital investment each
4242 recipient expended or allocated per project in this state;
4343 (F) [(6)] the total amount of grants made to each
4444 recipient;
4545 (G) [(7)] the average amount of money granted in
4646 this state for each job created in this state by grant recipients;
4747 (H) [(8)] the number of jobs created in this
4848 state by grant recipients in each sector of the North American
4949 Industry Classification System (NAICS); and
5050 (I) [(9)] of the number of direct jobs each
5151 recipient created in this state, the number of positions created
5252 that provide health benefits for employees; and
5353 (2) with respect to small business loans guaranteed by
5454 the fund:
5555 (A) the number of loans guaranteed by the fund;
5656 and
5757 (B) the average loan amount guaranteed.
5858 SECTION 3. This Act takes effect September 1, 2021.
