5	5		AN ACT
6	6		relating to providing notice to a state representative and senator
7	7		of an administrative penalty assessed by the Texas Commission on
8	8		Environmental Quality.
9	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10		SECTION 1. Section 7.060, Water Code, is amended to read as
11	11		follows:
12	12		Sec. 7.060. NOTICE OF PENALTY. If the commission is
13	13		required to give notice of a penalty under Section 7.057 or 7.059,
14	14		the commission shall:
15	15		(1) publish notice of its decision in the Texas
16	16		Register not later than the 10th day after the date on which the
17	17		decision is adopted; and
18	18		(2) notify the state representative and state senator
19	19		who represent the area where the violation for which the penalty is
20	20		being assessed occurred.
21	21		SECTION 2. Section 7.075(a), Water Code, is amended to read
22	22		as follows:
23	23		(a) Before the commission approves an administrative order
24	24		or proposed agreement to settle an administrative enforcement
25	25		action initiated under this subchapter to which the commission is a
26	26		party, the commission shall:
27	27		(1) allow the public to comment in writing on the
28	28		proposed order or agreement;
29	29		(2) publish notice [. Notice] of the opportunity to
30	30		comment on the proposed order or agreement [shall be published] in
31	31		the Texas Register not later than the 30th day before the date on
32	32		which the public comment period closes; and
33	33		(3) notify the state representative and state senator
34	34		who represent the area in which the violation that is the subject of
35	35		the proposed order or agreement occurred.
36	36		SECTION 3. This Act takes effect September 1, 2021.
