| 7 | 7 | | relating to the availability of certain information regarding an |
|---|
| 8 | 8 | | application for or the award of disaster recovery funds under the |
|---|
| 9 | 9 | | public information law. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 552.160, Government Code, is amended by |
|---|
| 12 | 12 | | amending Subsection (b) and adding Subsection (d) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (b) Except as provided by Subsections [Subsection] (c) and |
|---|
| 15 | 15 | | (d), the following information maintained by a governmental body is |
|---|
| 16 | 16 | | confidential: |
|---|
| 17 | 17 | | (1) the name, social security number, house number, |
|---|
| 18 | 18 | | street name, and telephone number of an individual or household |
|---|
| 19 | 19 | | that applies for state or federal disaster recovery funds; |
|---|
| 20 | 20 | | (2) the name, tax identification number, address, and |
|---|
| 21 | 21 | | telephone number of a business entity or an owner of a business |
|---|
| 22 | 22 | | entity that applies for state or federal disaster recovery funds; |
|---|
| 23 | 23 | | and |
|---|
| 24 | 24 | | (3) any other information the disclosure of which |
|---|
| 25 | 25 | | would identify or tend to identify a person or household that |
|---|
| 26 | 26 | | applies for state or federal disaster recovery funds. |
|---|
| 27 | 27 | | (d) Information is not confidential under Subsection (b) if |
|---|
| 28 | 28 | | the information is contained in or describes: |
|---|
| 29 | 29 | | (1) an application for or the award of state or federal |
|---|
| 30 | 30 | | disaster recovery funds to a governmental body; or |
|---|
| 31 | 31 | | (2) an application for or the award of state or federal |
|---|
| 32 | 32 | | disaster recovery funds that are allocated or distributed by a |
|---|
| 33 | 33 | | governmental body, other than information listed in Subsection |
|---|
| 34 | 34 | | (b)(1) or (2) concerning an applicant for that allocation or |
|---|
| 35 | 35 | | distribution. |
|---|
| 36 | 36 | | SECTION 2. The change in law made by this Act applies to |
|---|
| 37 | 37 | | information written, produced, collected, assembled, or maintained |
|---|
| 38 | 38 | | before, on, or after the effective date of this Act, but does not |
|---|
| 39 | 39 | | apply to a request for public information received before the |
|---|
| 40 | 40 | | effective date of this Act. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2021. |
