55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the availability of certain information regarding an
88 application for or the award of disaster recovery funds under the
99 public information law.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 552.160, Government Code, is amended by
1212 amending Subsection (b) and adding Subsection (d) to read as
1313 follows:
1414 (b) Except as provided by Subsections [Subsection] (c) and
1515 (d), the following information maintained by a governmental body is
1616 confidential:
1717 (1) the name, social security number, house number,
1818 street name, and telephone number of an individual or household
1919 that applies for state or federal disaster recovery funds;
2020 (2) the name, tax identification number, address, and
2121 telephone number of a business entity or an owner of a business
2222 entity that applies for state or federal disaster recovery funds;
2323 and
2424 (3) any other information the disclosure of which
2525 would identify or tend to identify a person or household that
2626 applies for state or federal disaster recovery funds.
2727 (d) Information is not confidential under Subsection (b) if
2828 the information is contained in or describes:
2929 (1) an application for or the award of state or federal
3030 disaster recovery funds to a governmental body; or
3131 (2) an application for or the award of state or federal
3232 disaster recovery funds that are allocated or distributed by a
3333 governmental body, other than information listed in Subsection
3434 (b)(1) or (2) concerning an applicant for that allocation or
3535 distribution.
3636 SECTION 2. The change in law made by this Act applies to
3737 information written, produced, collected, assembled, or maintained
3838 before, on, or after the effective date of this Act, but does not
3939 apply to a request for public information received before the
4040 effective date of this Act.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2021.
