66 AN ACT
77 relating to a grant program for mobile crisis outreach teams.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1010 amended by adding Section 531.09915 to read as follows:
1111 Sec. 531.09915. GRANT PROGRAM FOR MOBILE CRISIS OUTREACH
1212 TEAMS. (a) In this section, "mobile crisis outreach team" means a
1313 group of mental health professionals who assist adults and children
1414 who are experiencing a mental health crisis by providing a variety
1515 of services.
1616 (b) The executive commissioner shall establish and
1717 administer a mobile crisis outreach team grant program to grant
1818 money to municipalities and counties to establish local agencies
1919 that, in partnership with local law enforcement and local mental
2020 health authorities, provide an alternate response program under
2121 which a mobile crisis outreach team may be deployed in the
2222 municipality or county to appropriate situations determined not to
2323 require police intervention, for the purpose of reducing the number
2424 of incarcerations by the municipality or county of individuals
2525 with:
2626 (1) mental illness;
2727 (2) substance use disorders; or
2828 (3) intellectual or developmental disabilities.
2929 (c) A grant application from a municipality or county to the
3030 commission must be submitted on a form prescribed by the commission
3131 and include a statement from the governing body of the municipality
3232 or county regarding the municipal or county proposal to establish
3333 an alternate response program that includes:
3434 (1) training 9-1-1 emergency service dispatchers to
3535 distinguish between situations in which the dispatcher must deploy
3636 local law enforcement and situations in which a mobile crisis
3737 outreach team may be deployed instead;
3838 (2) creating collaborative training opportunities to
3939 increase mental health and trauma awareness for emergency medical
4040 services providers, local law enforcement, and mobile crisis
4141 outreach teams;
4242 (3) strengthening community engagement to raise
4343 awareness about mobile crisis outreach teams, including by
4444 establishing relationships between mobile crisis outreach teams
4545 and:
4646 (A) schools;
4747 (B) child protective services providers;
4848 (C) religious organizations;
4949 (D) nonprofit food bank or food pantries;
5050 (E) community health centers;
5151 (F) recreation centers; and
5252 (G) shelters designed to provide temporary
5353 living accommodations, including:
5454 (i) welfare hotels;
5555 (ii) congregate shelters; and
5656 (iii) transitional housing for persons with
5757 mental illness;
5858 (4) ensuring mobile crisis outreach teams provide
5959 appropriate care to individuals, especially individuals who lack
6060 adequate health insurance coverage, including by identifying
6161 options for individuals to receive care through:
6262 (A) shelters, as defined by Section 42.201, Human
6363 Resources Code;
6464 (B) crisis residential programs;
6565 (C) treatment centers;
6666 (D) after hours clinics; and
6767 (E) inpatient and outpatient treatment programs;
6868 (5) promoting access to any available free or
6969 affordable care through community mental health services
7070 providers;
7171 (6) increasing the availability of public
7272 transportation and other transportation options for individuals
7373 who require mental health services;
7474 (7) employing as mobile crisis outreach team members
7575 individuals who:
7676 (A) hold degrees in relevant behavioral health
7777 fields and have received appropriate training to serve on a mobile
7878 crisis outreach team; or
7979 (B) are licensed mental health professionals;
8080 and
8181 (8) providing comprehensive and continuing training
8282 to employees of mobile crisis outreach teams about:
8383 (A) suicide;
8484 (B) risk assessment;
8585 (C) crisis intervention;
8686 (D) issues relevant to marginalized populations;
8787 and
8888 (E) bias awareness.
8989 (d) The executive commissioner shall develop criteria for
9090 the evaluation of applications submitted under this section and the
9191 selection of recipients for a grant under the mobile crisis
9292 outreach team grant program. The executive commissioner shall award
9393 grants on a competitive basis.
9494 (e) A grant awarded under this section may not exceed $5
9595 million.
9696 (f) A municipality or county that receives a grant under
9797 this section is required to leverage funds in an amount:
9898 (1) equal to 50 percent of the grant amount if:
9999 (A) the county has a population of less than
100100 250,000; or
101101 (B) the municipality is located in a county with
102102 a population of less than 250,000;
103103 (2) equal to 100 percent of the grant amount if:
104104 (A) the county has a population of 250,000 or
105105 more; or
106106 (B) the municipality is located in a county with
107107 a population of 250,000 or more; and
108108 (3) equal to the percentage of the grant amount
109109 otherwise required by this subsection for the largest county in
110110 which a mobile crisis outreach team is located if the mobile crisis
111111 outreach team is located in more than one county.
112112 (g) A municipality or county that receives a grant under
113113 this section may also accept:
114114 (1) gifts, grants, and donations;
115115 (2) money donated from the budget of a law enforcement
116116 agency;
117117 (3) money donated from the budget of a municipality or
118118 county; and
119119 (4) money donated from the budget of a local mental
120120 health authority.
121121 (h) The executive commissioner shall adopt all rules
122122 necessary for the establishment of the mobile crisis outreach team
123123 grant program under this section.
124124 SECTION 2. As soon as practicable after the effective date
125125 of this Act, the executive commissioner of the Health and Human
126126 Services Commission shall adopt rules necessary to implement
127127 Section 531.09915, Government Code, as added by this Act.
128128 SECTION 3. This Act takes effect September 1, 2021.
