79 relating to the transfer of certain real property held by the Texas
810 Department of Criminal Justice.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. (a) As soon as practicable after the effective
1113 date of this Act, the Texas Department of Criminal Justice shall
1214 transfer to the City of Burnet the real property described by
1315 Section 2 of this Act.
1416 (b) The City of Burnet shall use the property transferred
1517 under this Act only for a purpose that benefits the public interest
1618 of the state. If the City of Burnet uses the property for any
1719 purpose other than a purpose that benefits the public interest of
1820 the state, ownership of the property automatically reverts to the
1921 Texas Department of Criminal Justice.
2022 (c) The Texas Department of Criminal Justice shall transfer
2123 the property by an appropriate instrument of transfer. The
2224 instrument of transfer must provide that:
2325 (1) the City of Burnet use the property only for a
2426 purpose that benefits the public interest of the state; and
2527 (2) ownership of the property will automatically
2628 revert to the Texas Department of Criminal Justice if the City of
2729 Burnet uses the property for any purpose other than a purpose that
2830 benefits the public interest of the state.
2931 (d) The Texas Department of Criminal Justice shall retain
3032 custody of the instrument of transfer after the instrument of
3133 transfer is filed in the real property records of Burnet County.
3234 SECTION 2. The real property referred to in Section 1 of
3335 this Act is described as follows:
3436 A 28.157 ACRE TRACT OUT OF THE EUGENIO PEREZ SURVEY NO. 41, ABSTRACT
3537 NO. 672, BURNET COUNTY, TEXAS, OF LAND AS DESCRIBED IN THE REMAINDER
3638 TRACT OF A CALLED 300.000 ACRE TRACT OF LAND AS DESCRIBED IN
3739 DOCUMENT TO THE STATE OF TEXAS, RECORDED ON VOLUME 608, PAGE 19 OF
3840 THE REAL PROPERTY RECORDS OF BURNET COUNTY, TEXAS, SAID 28.157 ACRE
3941 TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS
4042 DESCRIPTION AS FOLLOWS:
4143 BEGINNING at a found 5/8" iron pin, at the northwesterly corner of a
4244 called 20.611 acre tract of land as described in document to the
4345 City of Burnet, recorded in Volume 300, Page 184 of the Deed Records
4446 of Burnet County, Texas, at the southwesterly corner of the
4547 variable width right-of-way of Ellen Halbert Drive, along the
4648 easterly line of the remnant of said 300.000 acre tract, and being
4749 an easterly angle point hereof;
4850 THENCE South 13°58'54" East, along the westerly line of said 20.611
4951 acre tract, the westerly line of a called 2.259 acre tract of land
5052 as described in document to the City of Burnet, Recorded in Document
5153 No. 200908664 of the Official Public Records of Burnet County,
5254 Texas, a distance of 1844.69' to a 1/2" iron pin set with "CUPLIN"
5355 property cap, along the northerly line of a called 61.30 acre tract
5456 of land as described in document to the City of Burnet, recorded in
5557 Document No. 201904590 of the Official Public Records of Burnet
5658 County, Texas, along the southerly line of the remnant tract of said
5759 300.000 acre tract, and being the southeasterly corner hereof, from
5860 whence a found 1/2" iron pin at the southeasterly corner of said
5961 2.259 acre tract bears North 75°50'42" East, a distance of 255.72';
6062 THENCE South 75°50'42" West, along the northerly line of said 61.30

9597 THENCE South 14°02'32" East, along the westerly right-of-way line of
9698 said Ellen Halbert Drive, the easterly line of said 70' wide access
9799 easement, the easterly line of the remnant tract of said 300.000
98100 acre tract, and hereof, a distance of 27.05' to a 1/2" iron pin
99101 found, at the southeasterly corner of said 70' wide access
100102 easement, and being an easterly angle point hereof;
101103 THENCE South 13°40'34" East, along the westerly right-of-way line of
102104 said Ellen Halbert Drive, the easterly line of the remnant tract of
103105 said 300.000 acre tract, and hereof, a distance of 68.74' to the
104106 POINT OF BEGINNING, containing 28.157 acres, more or less.
105107 SECTION 3. This Act takes effect immediately if it receives
106108 a vote of two-thirds of all the members elected to each house, as
107109 provided by Section 39, Article III, Texas Constitution. If this
108110 Act does not receive the vote necessary for immediate effect, this
109111 Act takes effect September 1, 2021.
