410 AN ACT
511 relating to energy savings performance contracts.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Section 302.001(4), Local Government Code, is
814 amended to read as follows:
915 (4) "Energy savings performance contract" means a
1016 contract with a provider for energy or water conservation or usage
1117 measures in which the estimated energy savings, utility cost
1218 savings, increase in billable revenues, or increase in meter
1319 accuracy resulting from the measures is subject to guarantee to
1420 offset the cost of the energy or water conservation or usage
1521 measures over a specified period. The term does not include the
1622 design or new construction of a water supply project, water plant,
1723 wastewater plant, water and wastewater distribution or conveyance
1824 facility, or drainage project. The term includes a contract
1925 related to the pilot program described by Subdivision (9-a) and a
2026 contract for the installation or implementation of the following in
2127 new or existing facilities, including all causally connected work:
2228 (A) insulation of a building structure and
2329 systems within the building;
2430 (B) storm windows or doors, caulking or weather
2531 stripping, multiglazed windows or doors, heat-absorbing or
2632 heat-reflective glazed and coated window or door systems, or other
2733 window or door system modifications that reduce energy consumption;
2834 (C) automatic energy control systems, including
2935 computer software and technical data licenses;
3036 (D) heating, ventilating, or air-conditioning
3137 system modifications or replacements that reduce energy or water
3238 consumption;
3339 (E) lighting fixtures that increase energy
3440 efficiency;
3541 (F) energy recovery systems;
3642 (G) electric systems improvements;
3743 (H) water-conserving fixtures, appliances, and
3844 equipment or the substitution of non-water-using fixtures,
3945 appliances, and equipment;
4046 (I) water-conserving landscape irrigation
4147 equipment;
4248 (J) landscaping measures that reduce watering
4349 demands and capture and hold applied water and rainfall, including:
4450 (i) landscape contouring, including the use
4551 of berms, swales, and terraces; and
4652 (ii) the use of soil amendments that
4753 increase the water-holding capacity of the soil, including compost;
4854 (K) rainwater harvesting equipment and equipment
4955 to make use of water collected as part of a storm-water system
5056 installed for water quality control;
5157 (L) equipment for recycling or reuse of water
5258 originating on the premises or from other sources, including
5359 treated municipal effluent;
5460 (M) equipment needed to capture water from
5561 nonconventional, alternate sources, including air-conditioning
5662 condensate or graywater, for nonpotable uses;
5763 (N) metering or related equipment or systems that
5864 improve the accuracy of billable-revenue-generation systems;
5965 (O) alternative fuel programs resulting in
6066 energy cost savings and reduced emissions for local government
6167 vehicles, including fleet vehicles;
6268 (P) programs resulting in utility cost savings;
6369 or
6470 (Q) other energy or water conservation-related
6571 improvements or equipment, including improvements or equipment
6672 relating to renewable energy or nonconventional water sources or
6773 water reuse.
6874 SECTION 2. Section 302.005, Local Government Code, is
6975 amended by adding Subsections (d) and (e) to read as follows:
7076 (d) The scope of an energy savings performance contract may
7177 not be modified under this section by change order, contract
7278 addendum, or other method:
7379 (1) to perform work that is not related to, connected
7480 with, or otherwise ancillary to the measures identified in the
7581 original scope of an energy savings performance contract; or
7682 (2) in a way that increases the price of the original
7783 awarded contract by more than 25 percent of the original contract
7884 value.
7985 (e) Subsection (d) applies only to the design or
8086 construction of a water supply project, water plant, wastewater
8187 plant, water and wastewater distribution or conveyance facility, or
8288 drainage project.
8389 SECTION 3. Chapter 302, Local Government Code, is amended
8490 by adding Section 302.008 to read as follows:
8591 Sec. 302.008. ENFORCEMENT. (a) A contract entered into or
8692 an arrangement made in violation of this chapter is voidable as
8793 against public policy.
8894 (b) This chapter may be enforced through an action for
8995 declaratory or injunctive relief filed not later than the 10th day
9096 after the date the contract is awarded.
9197 SECTION 4. The changes in law made by this Act do not apply
9298 to an energy savings performance contract entered into before the
9399 effective date of this Act, and the former law governing the
94100 contract is continued in effect for that purpose.
95101 SECTION 5. This Act takes effect immediately if it receives
96102 a vote of two-thirds of all the members elected to each house, as
97103 provided by Section 39, Article III, Texas Constitution. If this
98104 Act does not receive the vote necessary for immediate effect, this
99105 Act takes effect September 1, 2021.
