66 AN ACT
77 relating to information regarding certain noncompliance by an
88 appraisal district in the Texas Department of Licensing and
99 Regulation records of a professional property tax appraiser serving
1010 as chief appraiser for the district.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 1151, Occupations Code, is
1313 amended by adding Section 1151.109 to read as follows:
1414 Sec. 1151.109. INFORMATION ON APPRAISAL DISTRICT
1515 NONCOMPLIANCE. (a) The commission by rule shall require the
1616 department to add a notation of noncompliance in the record of a
1717 registered professional appraiser who is serving as chief appraiser
1818 for an appraisal district that the department determines under
1919 Section 5.102(e), Tax Code, has failed to comply with the
2020 comptroller's recommendations following a review of the district
2121 under that section.
2222 (b) A local governmental entity may request from the
2323 department information on a registered professional appraiser the
2424 entity is considering for appointment as chief appraiser of the
2525 entity's appraisal district. The department shall inform the
2626 entity of a notation of noncompliance under Subsection (a) if the
2727 appraiser during two or more previous reviews under Section 5.102,
2828 Tax Code, served as chief appraiser of an appraisal district that
2929 the department determined had failed to comply with the
3030 comptroller's recommendations under that section.
3131 SECTION 2. As soon as practicable after the effective date
3232 of this Act, the Texas Commission of Licensing and Regulation shall
3333 adopt rules to implement Section 1151.109, Occupations Code, as
3434 added by this Act.
3535 SECTION 3. This Act takes effect September 1, 2021.
