| 8 | 8 | | handgun during a state of disaster or state of emergency. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 411, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 411.1851 to read as follows: |
|---|
| 12 | 12 | | Sec. 411.1851. LICENSE PROCESSING NOT AFFECTED BY STATE OF |
|---|
| 13 | 13 | | EMERGENCY OR STATE OF DISASTER. Notwithstanding a declaration of a |
|---|
| 14 | 14 | | state of emergency under Section 433.001, a state of disaster under |
|---|
| 15 | 15 | | Section 418.014, or a local state of disaster under Section |
|---|
| 16 | 16 | | 418.108, or any other executive order or proclamation related to |
|---|
| 17 | 17 | | the disaster or emergency, the department: |
|---|
| 18 | 18 | | (1) may not refuse to accept an application under |
|---|
| 19 | 19 | | Section 411.174 for a license to carry a handgun, if the application |
|---|
| 20 | 20 | | has been properly completed in accordance with that section; |
|---|
| 21 | 21 | | (2) shall allow the submission of fingerprints under |
|---|
| 22 | 22 | | Section 411.175; |
|---|
| 23 | 23 | | (3) shall review application materials in accordance |
|---|
| 24 | 24 | | with Section 411.176; |
|---|
| 25 | 25 | | (4) shall issue a license to carry a handgun under |
|---|
| 26 | 26 | | Section 411.177 in accordance with that section; |
|---|
| 27 | 27 | | (5) may not deny, revoke, or suspend a license to carry |
|---|
| 28 | 28 | | a handgun, except as expressly authorized under this subchapter; |
|---|
| 29 | 29 | | (6) may not refuse to accept or process a notice |
|---|
| 30 | 30 | | regarding a change of information or applications for a duplicate |
|---|
| 31 | 31 | | license under Section 411.181; and |
|---|
| 32 | 32 | | (7) may not refuse to accept or process an application |
|---|
| 33 | 33 | | to renew a license under Section 411.185, if the application has |
|---|
| 34 | 34 | | been properly completed in accordance with that section. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2021. |
