A BILL TO BE ENTITLED
AN ACT
relating to the generation of electricity using a wind-powered
generation facility.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39.351, Utilities Code, is amended by
adding Subsection (d) to read as follows:
(d) The commission by rule shall require a person registered
under this section who operates a wind-powered generation facility
to maintain the capability to generate at least 75 percent of the
facility's nameplate capacity as a condition of maintaining the
registration.
SECTION 2. This Act takes effect September 1, 2021.
