| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 1101, Occupations Code, is amended by |
|---|
| 11 | 11 | | adding Subchapter K-1 to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER K-1. RENTAL LOCATOR PERMIT REQUIREMENTS |
|---|
| 13 | 13 | | Sec. 1101.521. RENTAL LOCATOR PERMIT. (a) The commission |
|---|
| 14 | 14 | | shall adopt rules to provide for the issuance of a rental locator |
|---|
| 15 | 15 | | permit to an applicant who: |
|---|
| 16 | 16 | | (1) is 18 years of age or older; |
|---|
| 17 | 17 | | (2) has a high school diploma or the equivalent of a |
|---|
| 18 | 18 | | high school diploma; |
|---|
| 19 | 19 | | (3) completes a training course on rental locating |
|---|
| 20 | 20 | | approved by the commission; |
|---|
| 21 | 21 | | (4) has not, in the two years preceding the date of the |
|---|
| 22 | 22 | | application, held a rental locator permit issued under this |
|---|
| 23 | 23 | | section; |
|---|
| 24 | 24 | | (5) is sponsored by a licensed broker; |
|---|
| 25 | 25 | | (6) is currently enrolled in qualifying real estate |
|---|
| 26 | 26 | | courses required for a sales agent or broker license; and |
|---|
| 27 | 27 | | (7) pays an application fee in an amount set by the |
|---|
| 28 | 28 | | commission. |
|---|
| 29 | 29 | | (b) A rental locator permit expires on the 120th day after |
|---|
| 30 | 30 | | the date of issuance and may not be renewed. |
|---|
| 31 | 31 | | (c) Notwithstanding Section 1101.351(a), a person who holds |
|---|
| 32 | 32 | | a permit issued under this section may act as a residential rental |
|---|
| 33 | 33 | | locator. The permit holder must be supervised by the sponsoring |
|---|
| 34 | 34 | | broker. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2021. |
