66 AN ACT
77 relating to a rental locator permit issued by the Texas Real Estate
88 Commission; authorizing a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1101, Occupations Code, is amended by
1111 adding Subchapter K-1 to read as follows:
1212 SUBCHAPTER K-1. RENTAL LOCATOR PERMIT REQUIREMENTS
1313 Sec. 1101.521. RENTAL LOCATOR PERMIT. (a) The commission
1414 shall adopt rules to provide for the issuance of a rental locator
1515 permit to an applicant who:
1616 (1) is 18 years of age or older;
1717 (2) has a high school diploma or the equivalent of a
1818 high school diploma;
1919 (3) completes a training course on rental locating
2020 approved by the commission;
2121 (4) has not, in the two years preceding the date of the
2222 application, held a rental locator permit issued under this
2323 section;
2424 (5) is sponsored by a licensed broker;
2525 (6) is currently enrolled in qualifying real estate
2626 courses required for a sales agent or broker license; and
2727 (7) pays an application fee in an amount set by the
2828 commission.
2929 (b) A rental locator permit expires on the 120th day after
3030 the date of issuance and may not be renewed.
3131 (c) Notwithstanding Section 1101.351(a), a person who holds
3232 a permit issued under this section may act as a residential rental
3333 locator. The permit holder must be supervised by the sponsoring
3434 broker.
3535 SECTION 2. This Act takes effect September 1, 2021.
