| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Subchapter C, Chapter 352, Labor Code, is |
|---|
| 11 | 13 | | amended by adding Section 352.109 to read as follows: |
|---|
| 12 | 14 | | Sec. 352.109. APPORTIONED VEHICLE MODIFICATION SERVICES. |
|---|
| 13 | 15 | | (a) If, after a vehicle modification review is conducted, it is |
|---|
| 14 | 16 | | determined that a portion of an applicant's requested vehicle |
|---|
| 15 | 17 | | modifications is not safe, the commission shall: |
|---|
| 16 | 18 | | (1) inform the applicant about the unsafe |
|---|
| 17 | 19 | | modification; and |
|---|
| 18 | 20 | | (2) on the applicant's request, make a determination |
|---|
| 19 | 21 | | regarding whether the unsafe modification violates state or federal |
|---|
| 20 | 22 | | law or regulations and, if the commission determines that the |
|---|
| 21 | 23 | | unsafe modification does not violate applicable state or federal |
|---|
| 22 | 24 | | law or regulations: |
|---|
| 23 | 25 | | (A) provide those modifications that were |
|---|
| 24 | 26 | | determined safe; and |
|---|
| 25 | 27 | | (B) allow the applicant to pay out-of-pocket for |
|---|
| 26 | 28 | | those modifications that were determined unsafe. |
|---|
| 27 | 29 | | (b) The commission shall adopt rules necessary to implement |
|---|
| 28 | 30 | | this section. |
|---|
| 29 | 31 | | SECTION 2. This Act takes effect September 1, 2021. |
