10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 382.051961, Health and Safety Code, is | |
12 | 12 | amended by adding Subsection (d) to read as follows: | |
13 | 13 | (d) A permit by rule or a standard permit relating to a | |
14 | 14 | natural gas liquefaction facility and liquefied natural gas export | |
15 | 15 | terminal must require any elevated flare stack or ground flare | |
16 | 16 | located at the facility to be constructed in a manner that obscures | |
17 | 17 | from public view any flaring occurring at the facility. | |
18 | 18 | SECTION 2. Section 382.051961(d), Health and Safety Code, | |
19 | 19 | as added by this Act, applies only to a permit the application for | |
20 | 20 | which is filed with the Texas Commission on Environmental Quality | |
21 | 21 | on or after the effective date of this Act. A permit the | |
22 | 22 | application for which is filed before the effective date of this Act | |
23 | 23 | is governed by the law in effect on the date of filing, and that law | |
24 | 24 | is continued in effect for that purpose. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
