| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter H, Chapter 2155, Government Code, is |
|---|
| 10 | 10 | | amended by adding Section 2155.454 to read as follows: |
|---|
| 11 | 11 | | Sec. 2155.454. VENDORS WITH CERTAIN COMPENSATION RATIO. |
|---|
| 12 | 12 | | The comptroller and state agencies procuring goods or services |
|---|
| 13 | 13 | | shall give preference to vendors that compensate the chief |
|---|
| 14 | 14 | | executive officer of the vendor in an amount that does not exceed |
|---|
| 15 | 15 | | the median compensation of all employees multiplied by 45. |
|---|
| 16 | 16 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 17 | 17 | | to a contract for which a governmental entity first advertises or |
|---|
| 18 | 18 | | otherwise requests offers, bids, proposals, qualifications, or |
|---|
| 19 | 19 | | other applicable expressions of interest on or after the effective |
|---|
| 20 | 20 | | date of this Act. A contract for which a governmental entity first |
|---|
| 21 | 21 | | advertises or otherwise requests offers, bids, proposals, |
|---|
| 22 | 22 | | qualifications, or other applicable expressions of interest before |
|---|
| 23 | 23 | | the effective date of this Act is governed by the law as it existed |
|---|
| 24 | 24 | | immediately before the effective date of this Act, and that law is |
|---|
| 25 | 25 | | continued in effect for that purpose. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2021. |
