| 7 | 7 | | relating to designation by the purchaser of a motor vehicle of the |

| 8 | 8 | | county in which a motor vehicle dealer shall apply for the |
|---|
| 9 | 9 | | registration of and title for certain vehicles sold by the dealer; |
|---|
| 10 | 10 | | authorizing a civil penalty. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 501.0234, Transportation Code, is |
|---|
| 13 | 13 | | amended by amending Subsection (e) and adding Subsections (e-1) and |
|---|
| 14 | 14 | | (e-2) to read as follows: |
|---|
| 15 | 15 | | (e) The department shall develop a form [or electronic |
|---|
| 16 | 16 | | process] in which the purchaser of a motor vehicle shall designate |
|---|
| 17 | 17 | | the purchaser's choice as set out in Section 501.023 as the |
|---|
| 18 | 18 | | recipient of all taxes, fees, and other revenue collected as a |
|---|
| 19 | 19 | | result of the transaction, which the tax assessor-collector is |
|---|
| 20 | 20 | | authorized by law to retain. |
|---|
| 21 | 21 | | (e-1) A seller shall: |
|---|
| 22 | 22 | | (1) affirmatively present and explain the [make that] |
|---|
| 23 | 23 | | form [or electronic process available] to the purchaser of a |
|---|
| 24 | 24 | | vehicle at the time of purchase; |
|---|
| 25 | 25 | | (2) obtain the purchaser's designation and signature |
|---|
| 26 | 26 | | on the form; and |
|---|
| 27 | 27 | | (3) retain the form for at least one year after the |
|---|
| 28 | 28 | | date of purchase. |
|---|
| 29 | 29 | | (e-2) A seller who violates Subsection (e-1) is subject to a |
|---|
| 30 | 30 | | civil penalty of $5,000 for each violation. |
|---|
| 31 | 31 | | SECTION 2. Section 501.0234, Transportation Code, as |
|---|
| 32 | 32 | | amended by this Act, applies only to an application for the |
|---|
| 33 | 33 | | registration of or a title for a motor vehicle purchased on or after |
|---|
| 34 | 34 | | the effective date of this Act. An application for the registration |
|---|
| 35 | 35 | | of or a title for a motor vehicle purchased before the effective |
|---|
| 36 | 36 | | date of this Act is governed by the law in effect when the vehicle |
|---|
| 37 | 37 | | was purchased, and the former law is continued in effect for that |
|---|
| 38 | 38 | | purpose. |

| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2021. |
