| 5 | 14 | | relating to expanding the definition of bicycle to include devices |

| 8 | 17 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 18 | | SECTION 1. Section 541.201(2), Transportation Code, is |
|---|
| 10 | 19 | | amended to read as follows: |
|---|
| 11 | 20 | | (2) "Bicycle" means a device, excluding a moped, that |
|---|
| 12 | 21 | | [a person may ride and that: |
|---|
| 13 | 22 | | [(A)] is capable of being ridden solely using |
|---|
| 14 | 23 | | human power[;] and has either: |
|---|
| 15 | 24 | | (A) [(B) has] two tandem wheels at least one of |
|---|
| 16 | 25 | | which is more than 14 inches in diameter; |
|---|
| 17 | 26 | | (B) three wheels, two of which are in parallel, |
|---|
| 18 | 27 | | and at least one of the three wheels is more than 14 inches in |
|---|
| 19 | 28 | | diameter; or |
|---|
| 20 | 29 | | (C) any number of wheels and adaptive technology |
|---|
| 21 | 30 | | that allows the device to be ridden by a person with a disability. |

| 22 | 31 | | SECTION 2. This Act takes effect September 1, 2021. |
