44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the reimbursement of durable medical equipment
77 providers participating in the Medicaid managed care program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 533.005, Government Code, is amended by
1010 adding Subsection (i) to read as follows:
1111 (i) In addition to the requirements specified by Subsection
1212 (a) and notwithstanding any other law, a contract described by that
1313 subsection must require the managed care organization to reimburse
1414 a specialty provider of durable medical equipment, services, and
1515 supplies at a rate that is at least equal to 95 percent of the rate
1616 paid under the Medicaid fee schedule.
1717 SECTION 2. (a) The Health and Human Services Commission
1818 shall, in a contract between the commission and a managed care
1919 organization under Chapter 533, Government Code, that is entered
2020 into or renewed on or after the effective date of this Act, require
2121 that the managed care organization comply with Section 533.005(i),
2222 Government Code, as added by this Act.
2323 (b) The Health and Human Services Commission shall seek to
2424 amend contracts entered into with managed care organizations under

2626 to require those managed care organizations to comply with Section
2727 533.005(i), Government Code, as added by this Act. To the extent of

3131 the contract provision prevails.
3232 SECTION 3. If before implementing any provision of this Act
3333 a state agency determines that a waiver or authorization from a
3434 federal agency is necessary for implementation of that provision,
3535 the agency affected by the provision shall request the waiver or
3636 authorization and may delay implementing that provision until the
3737 waiver or authorization is granted.
3838 SECTION 4. This Act takes effect September 1, 2021.
