8 | 8 | | property-tax-related information. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 44.004(c), Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (c) The notice of public meeting to discuss and adopt the |
---|
13 | 13 | | budget and the proposed tax rate may not be smaller than one-quarter |
---|
14 | 14 | | page of a standard-size or a tabloid-size newspaper, and the |
---|
15 | 15 | | headline on the notice must be in 18-point or larger type. Subject |
---|
16 | 16 | | to Subsection (d), the notice must: |
---|
17 | 17 | | (1) contain a statement in the following form: |
---|
18 | 18 | | "NOTICE OF PUBLIC MEETING TO DISCUSS BUDGET AND PROPOSED TAX RATE |
---|
19 | 19 | | "The (name of school district) will hold a public meeting at |
---|
20 | 20 | | (time, date, year) in (name of room, building, physical location, |
---|
21 | 21 | | city, state). The purpose of this meeting is to discuss the school |
---|
22 | 22 | | district's budget that will determine the tax rate that will be |
---|
23 | 23 | | adopted. Public participation in the discussion is invited." The |
---|
24 | 24 | | statement of the purpose of the meeting must be in bold type. In |
---|
25 | 25 | | reduced type, the notice must state: "The tax rate that is |
---|
26 | 26 | | ultimately adopted at this meeting or at a separate meeting at a |
---|
27 | 27 | | later date may not exceed the proposed rate shown below unless the |
---|
28 | 28 | | district publishes a revised notice containing the same information |
---|
29 | 29 | | and comparisons set out below and holds another public meeting to |
---|
30 | 30 | | discuss the revised notice." In addition, in reduced type, the |
---|
31 | 31 | | notice must state: "Visit PropertyTaxes.Texas.gov to find a link to |
---|
32 | 32 | | your local property tax database on which you can easily access |
---|
33 | 33 | | information regarding your property taxes, including information |
---|
34 | 34 | | about proposed tax rates and scheduled public hearings of each |
---|
35 | 35 | | entity that taxes your property."; |
---|
36 | 36 | | (2) contain a section entitled "Comparison of Proposed |
---|
37 | 37 | | Budget with Last Year's Budget," which must show the difference, |
---|
38 | 38 | | expressed as a percent increase or decrease, as applicable, in the |
---|
39 | 39 | | amounts budgeted for the preceding fiscal year and the amount |
---|
40 | 40 | | budgeted for the fiscal year that begins in the current tax year for |
---|
41 | 41 | | each of the following: |
---|
42 | 42 | | (A) maintenance and operations; |
---|
43 | 43 | | (B) debt service; and |
---|
44 | 44 | | (C) total expenditures; |
---|
45 | 45 | | (3) contain a section entitled "Total Appraised Value |
---|
46 | 46 | | and Total Taxable Value," which must show the total appraised value |
---|
47 | 47 | | and the total taxable value of all property and the total appraised |
---|
48 | 48 | | value and the total taxable value of new property taxable by the |
---|
49 | 49 | | district in the preceding tax year and the current tax year as |
---|
50 | 50 | | calculated under Section 26.04, Tax Code; |
---|
51 | 51 | | (4) contain a statement of the total amount of the |
---|
52 | 52 | | outstanding and unpaid bonded indebtedness of the school district; |
---|
53 | 53 | | (5) contain a section entitled "Comparison of Proposed |
---|
54 | 54 | | Rates with Last Year's Rates," which must: |
---|
55 | 55 | | (A) show in rows the tax rates described by |
---|
56 | 56 | | Subparagraphs (i)-(iii), expressed as amounts per $100 valuation of |
---|
57 | 57 | | property, for columns entitled "Maintenance & Operations," |
---|
58 | 58 | | "Interest & Sinking Fund," and "Total," which is the sum of |
---|
59 | 59 | | "Maintenance & Operations" and "Interest & Sinking Fund": |
---|
60 | 60 | | (i) the school district's "Last Year's |
---|
61 | 61 | | Rate"; |
---|
62 | 62 | | (ii) the "Rate to Maintain Same Level of |
---|
63 | 63 | | Maintenance & Operations Revenue & Pay Debt Service," which: |
---|
64 | 64 | | (a) in the case of "Maintenance & |
---|
65 | 65 | | Operations," is the tax rate that, when applied to the current |
---|
66 | 66 | | taxable value for the district, as certified by the chief appraiser |
---|
67 | 67 | | under Section 26.01, Tax Code, and as adjusted to reflect changes |
---|
68 | 68 | | made by the chief appraiser as of the time the notice is prepared, |
---|
69 | 69 | | would impose taxes in an amount that, when added to state funds to |
---|
70 | 70 | | be distributed to the district under Chapter 48, would provide the |
---|
71 | 71 | | same amount of maintenance and operations taxes and state funds |
---|
72 | 72 | | distributed under Chapter 48 per student in average daily |
---|
73 | 73 | | attendance for the applicable school year that was available to the |
---|
74 | 74 | | district in the preceding school year; and |
---|
75 | 75 | | (b) in the case of "Interest & Sinking |
---|
76 | 76 | | Fund," is the tax rate that, when applied to the current taxable |
---|
77 | 77 | | value for the district, as certified by the chief appraiser under |
---|
78 | 78 | | Section 26.01, Tax Code, and as adjusted to reflect changes made by |
---|
79 | 79 | | the chief appraiser as of the time the notice is prepared, and when |
---|
80 | 80 | | multiplied by the district's anticipated collection rate, would |
---|
81 | 81 | | impose taxes in an amount that, when added to state funds to be |
---|
82 | 82 | | distributed to the district under Chapter 46 and any excess taxes |
---|
83 | 83 | | collected to service the district's debt during the preceding tax |
---|
84 | 84 | | year but not used for that purpose during that year, would provide |
---|
85 | 85 | | the amount required to service the district's debt; and |
---|
86 | 86 | | (iii) the "Proposed Rate"; |
---|
87 | 87 | | (B) contain fourth and fifth columns aligned with |
---|
88 | 88 | | the columns required by Paragraph (A) that show, for each row |
---|
89 | 89 | | required by Paragraph (A): |
---|
90 | 90 | | (i) the "Local Revenue per Student," which |
---|
91 | 91 | | is computed by multiplying the district's total taxable value of |
---|
92 | 92 | | property, as certified by the chief appraiser for the applicable |
---|
93 | 93 | | school year under Section 26.01, Tax Code, and as adjusted to |
---|
94 | 94 | | reflect changes made by the chief appraiser as of the time the |
---|
95 | 95 | | notice is prepared, by the total tax rate, and dividing the product |
---|
96 | 96 | | by the number of students in average daily attendance in the |
---|
97 | 97 | | district for the applicable school year; and |
---|
98 | 98 | | (ii) the "State Revenue per Student," which |
---|
99 | 99 | | is computed by determining the amount of state aid received or to be |
---|
100 | 100 | | received by the district under Chapters 43, 46, and 48 and dividing |
---|
101 | 101 | | that amount by the number of students in average daily attendance in |
---|
102 | 102 | | the district for the applicable school year; and |
---|
103 | 103 | | (C) contain an asterisk after each calculation |
---|
104 | 104 | | for "Interest & Sinking Fund" and a footnote to the section that, in |
---|
105 | 105 | | reduced type, states "The Interest & Sinking Fund tax revenue is |
---|
106 | 106 | | used to pay for bonded indebtedness on construction, equipment, or |
---|
107 | 107 | | both. The bonds, and the tax rate necessary to pay those bonds, were |
---|
108 | 108 | | approved by the voters of this district."; |
---|
109 | 109 | | (6) contain a section entitled "Comparison of Proposed |
---|
110 | 110 | | Levy with Last Year's Levy on Average Residence," which must: |
---|
111 | 111 | | (A) show in rows the information described by |
---|
112 | 112 | | Subparagraphs (i)-(iv), rounded to the nearest dollar, for columns |
---|
113 | 113 | | entitled "Last Year" and "This Year": |
---|
114 | 114 | | (i) "Average Market Value of Residences," |
---|
115 | 115 | | determined using the same group of residences for each year; |
---|
116 | 116 | | (ii) "Average Taxable Value of Residences," |
---|
117 | 117 | | determined after taking into account the limitation on the |
---|
118 | 118 | | appraised value of residences under Section 23.23, Tax Code, and |
---|
119 | 119 | | after subtracting all homestead exemptions applicable in each year, |
---|
120 | 120 | | other than exemptions available only to disabled persons or persons |
---|
121 | 121 | | 65 years of age or older or their surviving spouses, and using the |
---|
122 | 122 | | same group of residences for each year; |
---|
123 | 123 | | (iii) "Last Year's Rate Versus Proposed |
---|
124 | 124 | | Rate per $100 Value"; and |
---|
125 | 125 | | (iv) "Taxes Due on Average Residence," |
---|
126 | 126 | | determined using the same group of residences for each year; and |
---|
127 | 127 | | (B) contain the following information: "Increase |
---|
128 | 128 | | (Decrease) in Taxes" expressed in dollars and cents, which is |
---|
129 | 129 | | computed by subtracting the "Taxes Due on Average Residence" for |
---|
130 | 130 | | the preceding tax year from the "Taxes Due on Average Residence" for |
---|
131 | 131 | | the current tax year; |
---|
132 | 132 | | (7) contain the following statement in bold print: |
---|
133 | 133 | | "Under state law, the dollar amount of school taxes imposed on the |
---|
134 | 134 | | residence of a person 65 years of age or older or of the surviving |
---|
135 | 135 | | spouse of such a person, if the surviving spouse was 55 years of age |
---|
136 | 136 | | or older when the person died, may not be increased above the amount |
---|
137 | 137 | | paid in the first year after the person turned 65, regardless of |
---|
138 | 138 | | changes in tax rate or property value."; |
---|
139 | 139 | | (8) contain the following statement in bold print: |
---|
140 | 140 | | "Notice of Voter-Approval Rate: The highest tax rate the district |
---|
141 | 141 | | can adopt before requiring voter approval at an election is (the |
---|
142 | 142 | | school district voter-approval rate determined under Section |
---|
143 | 143 | | 26.08, Tax Code). This election will be automatically held if the |
---|
144 | 144 | | district adopts a rate in excess of the voter-approval rate of (the |
---|
145 | 145 | | school district voter-approval rate)."; and |
---|
146 | 146 | | (9) contain a section entitled "Fund Balances," which |
---|
147 | 147 | | must include the estimated amount of interest and sinking fund |
---|
148 | 148 | | balances and the estimated amount of maintenance and operation or |
---|
149 | 149 | | general fund balances remaining at the end of the current fiscal |
---|
150 | 150 | | year that are not encumbered with or by corresponding debt |
---|
151 | 151 | | obligation, less estimated funds necessary for the operation of the |
---|
152 | 152 | | district before the receipt of the first payment under Chapter 48 in |
---|
153 | 153 | | the succeeding school year. |
---|
154 | 154 | | SECTION 2. Section 25.19, Tax Code, is amended by adding |
---|
155 | 155 | | Subsection (m) to read as follows: |
---|
156 | 156 | | (m) A notice required by Subsection (a) or (g) must include |
---|
157 | 157 | | the following statement: "Beginning August 7th, visit |
---|
158 | 158 | | PropertyTaxes.Texas.gov to find a link to your local property tax |
---|
159 | 159 | | database on which you can easily access information regarding your |
---|
160 | 160 | | property taxes, including information regarding the amount of taxes |
---|
161 | 161 | | that each entity that taxes your property will impose if the entity |
---|
162 | 162 | | adopts its proposed tax rate. Your local property tax database will |
---|
163 | 163 | | be updated regularly during August and September as local elected |
---|
164 | 164 | | officials propose and adopt the property tax rates that will |
---|
165 | 165 | | determine how much you pay in property taxes." |
---|
166 | 166 | | SECTION 3. Section 26.04(e-2), Tax Code, is amended to read |
---|
167 | 167 | | as follows: |
---|
168 | 168 | | (e-2) By August 7 or as soon thereafter as practicable, the |
---|
169 | 169 | | chief appraiser of each appraisal district shall deliver by regular |
---|
170 | 170 | | mail or e-mail to each owner of property located in the appraisal |
---|
171 | 171 | | district a notice that the estimated amount of taxes to be imposed |
---|
172 | 172 | | on the owner's property by each taxing unit in which the property is |
---|
173 | 173 | | located may be found in the property tax database maintained by the |
---|
174 | 174 | | appraisal district under Section 26.17. The notice must include: |
---|
175 | 175 | | (1) the following [a] statement: "Visit |
---|
176 | 176 | | PropertyTaxes.Texas.gov to find a link to your local property tax |
---|
177 | 177 | | database on which you can easily access information regarding your |
---|
178 | 178 | | property taxes, including information regarding the amount of taxes |
---|
179 | 179 | | that each entity that taxes your property will impose if the entity |
---|
180 | 180 | | adopts its proposed tax rate. Your local property tax database will |
---|
181 | 181 | | be updated regularly during August and September as local elected |
---|
182 | 182 | | officials propose and adopt the property tax rates that will |
---|
183 | 183 | | determine how much you pay in property taxes." [directing the |
---|
184 | 184 | | property owner to an Internet website from which the owner may |
---|
185 | 185 | | access information related to the actions taken or proposed to be |
---|
186 | 186 | | taken by each taxing unit in which the property is located that may |
---|
187 | 187 | | affect the taxes imposed on the owner's property]; |
---|
188 | 188 | | (2) a statement that the property owner may request |
---|
189 | 189 | | from the county assessor-collector for the county in which the |
---|
190 | 190 | | property is located or, if the county assessor-collector does not |
---|
191 | 191 | | assess taxes for the county, the person who assesses taxes for the |
---|
192 | 192 | | county under Section 6.24(b), contact information for the assessor |
---|
193 | 193 | | for each taxing unit in which the property is located, who must |
---|
194 | 194 | | provide the information described by this subsection to the owner |
---|
195 | 195 | | on request; and |
---|
196 | 196 | | (3) the name, address, and telephone number of the |
---|
197 | 197 | | county assessor-collector for the county in which the property is |
---|
198 | 198 | | located or, if the county assessor-collector does not assess taxes |
---|
199 | 199 | | for the county, the person who assesses taxes for the county under |
---|
200 | 200 | | Section 6.24(b). |
---|
201 | 201 | | SECTION 4. Section 26.052, Tax Code, is amended by adding |
---|
202 | 202 | | Subsection (e-1) to read as follows: |
---|
203 | 203 | | (e-1) Public notice provided under Subsection (c) must |
---|
204 | 204 | | include the following statement: "Visit PropertyTaxes.Texas.gov to |
---|
205 | 205 | | find a link to your local property tax database on which you can |
---|
206 | 206 | | easily access information regarding your property taxes, including |
---|
207 | 207 | | information about proposed tax rates and scheduled public hearings |
---|
208 | 208 | | of each entity that taxes your property." |

209 | 209 | | SECTION 5. Sections 26.06(b-1), (b-2), and (b-3), Tax Code, |
---|
210 | 210 | | are amended to read as follows: |

211 | 211 | | (b-1) If the proposed tax rate exceeds the no-new-revenue |
---|
212 | 212 | | tax rate and the voter-approval tax rate of the taxing unit, the |
---|
213 | 213 | | notice must contain a statement in the following form: |

---|

397 | 397 | | and includes a method to assist a property owner to identify the |

398 | 398 | | appropriate property tax database for the owner's property. |

399 | 399 | | (c) The Internet website must provide a separate link to the |

400 | 400 | | Internet location of each property tax database. |
---|
401 | 401 | | (d) The address of the Internet website must be |
---|
402 | 402 | | "PropertyTaxes.Texas.gov." |
---|
403 | 403 | | SECTION 8. Section 49.236(a), Water Code, is amended to |

501 | 501 | | (4) include the following statement: "The 86th Texas |

502 | 502 | | Legislature modified the manner in which the voter-approval tax |

503 | 503 | | rate is calculated to limit the rate of growth of property taxes in |

---|
505 | 505 | | SECTION 9. Not later than January 1, 2022, the comptroller |
---|
506 | 506 | | of public accounts shall develop the Internet website required by |
---|
507 | 507 | | Section 26.175, Tax Code, as added by this Act. |
---|
508 | 508 | | SECTION 10. The changes in law made by this Act apply only |
---|
509 | 509 | | to a notice required to be delivered for an ad valorem tax year that |
---|
510 | 510 | | begins on or after January 1, 2022. |
---|
511 | 511 | | SECTION 11. This Act takes effect immediately if it |
---|
512 | 512 | | receives a vote of two-thirds of all the members elected to each |
---|
513 | 513 | | house, as provided by Section 39, Article III, Texas Constitution. |
---|
514 | 514 | | If this Act does not receive the vote necessary for immediate |
---|
515 | 515 | | effect, this Act takes effect September 1, 2021. |
